The problem of the spread of the coronavirus epidemic is now being widely discussed not only in the media, but also in legislative and executive authorities, business and scientific circles around the world, including in Russia. The article provides a brief overview of the main epidemics that occurred in modern world history, their impact on the economy of individual countries and the world economy as a whole. The main attention is paid to the analysis of the impact degree of epidemics and pandemics on the transport sector of the economy. The specificity of the impact of the spread of mass diseases on the functioning of transport system and its’ economic security is shown. Possible directions of organizational and legal support for the activities aimed at minimizing the consequences of the pandemic on the economic security of transport are substantiated.
Background. The activities of military medical examination bodies is a relevant subject of research, since by their medical and legal nature they affect a wide range of citizens who are undergoing military service (service in law enforcement agencies). In relation to these persons, according to the results of a medical examination and medical examination, military medical commissions issue various types of conclusions. Since the above conclusions are a document affecting the rights and freedoms of these persons, the scope of guarantees and compensations provided depends on these decisions, they (decisions, conclusions) are subject to appeal in administrative and civil proceedings. Accordingly, the resolution of these issues may become the subject of various medical examinations in court. When conducting a military medical examination in court, the courts may encounter practical law enforcement difficulties associated with the lack of regulation of this issue in the legislation governing the conduct of military medical examination. Materials and research methods. Based on the application of the methods of comparative jurisprudence, systemic and structural-functional analysis, the scientific literature, regulatory legal acts and court decisions on the issues of judicial appeal against the conclusions of the military medical examination are consistently studied. The analysis also examines the aspects of the appointment of a military medical examination in court, the features of the actions of the conclusions of military medical commissions in this case and their assessment as evidence in the implementation of legal proceedings. Results. Based on the study of scientific literature, the requirements of regulatory legal acts and law enforcement practice, it is proposed to amend the Regulations on military medical examination, in order to resolve the issues of issuing an opinion by the military medical commission, in the event of a military medical examination in court. ... Currently, the specified procedure is not defined, which leads to practical difficulties for the law enforcement officer. Conclusion. The proposed amendments to the Regulations on military medical expertise will fully resolve the issue of appointment and conduct of military medical expertise in court, as well as determine the scope of such conclusions and compensation for the cost.
The article deals with problematic issues of ensuring the effective functioning of transport infrastructure in modern conditions, when the amount of universal threats from terrorism and other factors constantly increases. The definition of "facility security” is formulated, since "transport security", being considered in the narrow sense, includes only the protection of transport infrastructure facilities from terrorist crimes and does not cover other illegal actions that can have a negative impact on the security of transport system in Russia. Profound study of the issues of legal regulation of ensuring the security of transport infrastructure facilities in various aspects leads the authors to reasonable conclusion about their obvious gaps and, in part, conflict of laws, which determines the need to resolve these problems of positive law in Russia. The need to improve the anti-terrorist protection of railway transport facilities by establishing the priority of interdepartmental integrated approach is stipulated and particular measures to mitigate the terrorist threat are suggested.
The article analyzes Russian historical and legal heritage containing the norms governing social relations that arose in the process of development of water and inland roads, transportation, state administration in the transport field, and studies the most important norms of Russian transport legislation. The purpose of the research was to study legal regulation of transport relations in the historical period from 9th through 18th centuries in order to identify the main stages of development and periodization of domestic transport law.The study was carried out using methods of legal analysis, including formal-dogmatic method, which allowed to reveal some of shortcomings and gaps of legal regulation; historical and legal method, that, in combination with the methods of taxonomic analysis, made it possible to carry out authors’ periodization of formation of transport legislation during the studied period. The use of achievements of legal hermeneutics and tools of the linguistic-semiotic and semantic approaches provided an opportunity to clarify the content of legal norms and legal documents referring to the period under review.The results of the study are of interest from the point of view of revealing historical patterns of development of transport law, make it possible to assess the role and place of transport legislation in the system of legal regulators of public relations. The presented scientific results, taking into account already existing and practically substantiated developments, can serve as a starting point for further discussion about the prospects, trends and directions of development of Russian transport law and transport legislation.
