Perkembangan ekonomi dan perdagangan menyebabkan timbulnya banyak permasalahan utang-piutang di dalam masyarakat dengan diikuti krisis moneter yang terjadi di Indonesia memberikan dampak negatif terhadap perekonomian nasional. Undang-Undang Nomor 37 Tahun 2004 tentang Kepailitan dan PKPU dibentuk guna memenuhi kepentingan dunia usaha dalam memenuhi kepentingan dunia usaha dalam menyelesaikan masalah-masalah utang-piutang secara adil, cepat, terbuka dan efeketif. Problematik terhadap tujuan UU No. 37 Tahun 2004 tentang Kepailitan dan PKPU terdapat dalam ketentuan kreditor separatis yang dilakukan oleh sebuah bank, dimana kedudukan bank sebagai kreditor separatis masih belum berjalan secara optimal terutama perlindungan hukumnya yang belum secara tegas diberlakukan. Permasalahan yang timbul adalah bagaimana kedudukan bank sebagai kreditor separatis beserta perlindungan hukumnya di dalam Kepailitan berdasarkan UU No. 37 Tahun 2004 tentang Kepailitan dan PKPU. Tujuan yang ingin dicapai adalah untuk mengetahui kedudukan dan perlindungan hukum bank sebagai kreditor separatis berdasarkan UU No. 37 Tahun 2004 tentang Kepailitan dan PKPU. Metode penelitian yang digunakan adalah yuridis empiris dengan menggunakan data primer sebagai data utama selain data sekunder, melalui teknik observasi dan wawancara, dianalisis secara kualitatif dan disimpulkan secara induktif. Hasil penelitian diketahui bahwa dalam kepailitan, kedudukan bank sebagai kreditor separatis adalah bank sebagai kreditor yang istimewa, dikarenakan bank sebagai kreditor pemegang hak jaminan kebendaan yang dapat mengeksekusi jaminannya sewaktu-waktu apabila debitor cidera janji atau wanprestasi, Wujud perlindungan hukum terhadap bank adalah hak mengeksekusi jaminannya yang dapat dilakukan seolah-olah tidak terjadi kepailitan sebagaimana diatur dalam ketentuan pasal 55 UU No. 37 Tahun 2004 tentang Kepailitan dan PKPU.

The Financial Services Authority (OJK) is an institution formed with one of its objectives that is protecting Consumers and public interets. OJK provides complaint services by having an adequate system, making the complaint mechanisms of Consumers handling and facilitating complaints settlement. The complaint mechanism is carried out by establishing two stages of Consumers services, namely internal dispute resolution (IDR) which, if not completed, enters the external dispute resolution (EDR) stage, namely the court and the alternative dispute resolution institution that received OJK approval, namely LAPS SJK. In addition, at the beginning of 2022, OJK prepared a system, namely the Consumer Protection Portal Application (APPK) as a forum for resolving complaints at the IDR stage and through APPK the complaints can be forwarded by consumers to LAPS SJK. The purpose of this research is to know and understand legal certainty aspect in the appointment of the LAPS SJK forum that associated with the basic principle of dispute resolution which is the agreement between the parties including Financial Services (PUJK). This research was conducted using normative research with data collection through literature study. Based on the results of the research, PUJK’s agreement is needed in choosing the forum of settlement whether through the court or alternative dispute resolution. But as stipulated in the regulations, the alternative dispute resolution institution for financial services just LAPS SJK.
Business actors need information regarding the implications of the latest laws and regulations for their business activities. Many companies have carried out corporate action activities during the Covid-19 pandemic. This corporate action requires approval from creditors, especially bank financial institutions. Bank leaders need knowledge of regulations and the implications of each regulation on decisions to be taken. This training provides information on new regulations, including the Job Creation Law, Information and Electronic Transaction Law, and the proposed Personal Data Protection (PDP Law. The training is conducted using the webinar method in order to reach bank leaders throughout Indonesia. The results of this webinar have enriched the knowledge of bank leaders regarding the laws and regulations, especially their implications for the banking business. Keywords: corporate action; business law; banking Abstrak: Pelaku usaha memerlukan informasi mengenai implikasi peraturan perundang-undangan terbaru terhadap kegiatan usaha yang dijalankannya. Banyak perusahaan telah melakukan kegiatan aksi korporasi selama pandemi Covid-19. Aksi korporasi ini memerlukan persetujuan dari pada kreditor, khususnya lembaga keuangan bank. Para pimpinan bank memerlukan pengetahuan mengenai peraturan dan implikasi setiap peraturan terhadap keputusan yang akan diambil. Pelatihan ini memberikan informasi mengenai peraturan yang baru, di antaranya UU CK, UU ITE, dan rencana UU PDP. Pelatihan dilakukan dengan metode webinar agar dapat menjangkau para pimpinan bank yang berada di seluruh Indonesia.
