In the current era, transportation is a common means used to transport goods or people from one place to another. Transportation is considered considered to have become a basic need for every human being to carry out various daily activities such as work or as a business support so that it can be said that transportation in the present era has become the heart in every activity carried out by humans. Land transportation which used to carry out its activities in certain places, but in the millennium has now mushroomed and began to be favored or loved by the general public, namely online based land transportation so as to bring up the use of cellphones or telecommunications equipment used by transporters in this case online transportation. This research is a legal research using a sociological juridical approach. The specification of this study is descriptive analytical, because this study can provide an overview and analysis, which is thoroughly systematically regarding the reality in the field, especially regarding the regulation of cellphone use while driving contained in legislation. Data collection is done by conducting observations and interviews and by using applicable legislation. Application-based mobile users are facilitated by the existence of fast online booking mode services called application-based online motorcycle taxis. By making an online order automatically an online agreement will arise between the two parties between the driver and user or passenger. The agreement in the online motorcycle taxi is displayed or appears on the passenger and driver's cellphone as a travel transaction that has been agreed by both. Electronic transactions in online motorcycle taxi trips are agreements that are inherent to both parties in a transportation activity. By ordering online, an online agreement will arise automatically between the two parties between the driver and the user or passenger. An online motorcycle taxi agreement is printed or appears on the passenger and driver's cellphone as a travel transaction agreed upon by both. Electronic transactions in online motorcycle taxi trips are agreements that are inherent to both parties in a transportation activity. Prohibition of using cellphones or cellphones on the road while driving as stated in the legislation, namely Law Number 22 Year 2009 concerning Road Traffic and Transportation stated in article 106 paragraph (1) which states that "every person driving a motorized vehicle on the road must drive the vehicle properly and full of concentration "so that the emergence of policies or legal actions taken by the police is to apply the 3E method, namely: Engineering, Education and Enforcement.
Transportasi dinilai sangat penting selain digunakan sebagai alat perpindahan orang maupun barang, transportasi pun berguna untuk mempercepat roda perekonomian, hal ini dikarenakan tanpa transportasi maka segala aktifitas akan terkendala sehingga mengakibatkan terkendalanya perekonomian. Ditandainya perubahan mengenai moda transportasi online, hal ini berdampak pula pada perkembangan dari sistem pekerjaan yang semula menggunakan sistem konvensional menjadi sistem aplikasi online.Penelitian hukum ini mempergunakan pendekatan yuridis normatif. Spesifikasi penelitian menggunakan deskriptif analitis, penelitian ini diharapkan dapat memunculkan gambaran serta analisis, yang menyeluruh dengan secara sistematis mengenai kenyataan yang ada di lapangan khususnya mengenai tentang penerapan perjanjian hubungan kerja dan perlindungan sebagaimana yang terdapat di dalam perundang-undangan. Pengumpulan data dilakukan dengan cara melakukan observasi dan wawancara serta dengan menggunakan perundang-undangan yang berlaku.Perjanjian kemitraan yang memiliki bentuk perjanjian sebagai perjanjian bagi hasil, perjanjian keagenan, dan perjanjian sub-kontrak. Sehingga sesuai dengan isi dari perjanjian kemitraan bahwa perusahaan transportasi onlinememposisikan pekerja atau driver sebagai mitra kerja dalam menjalankan kegiatan transportasi. Perjanjian hubungan kerja kemitraan tidak mengenal adanya atasan (majikan) dan bawahan seperti yang dikenal di dalam perjanjian kerja namun dalam perjanjian kemitraan semua pihak berada pada posisi yang sama kedudukannya. Dalam kegiatan transportasi online ialah perjanjian kemitraan yang memilki sifat kesetaraan para pihak sehingga dalam pelaksanaan unsur-unsur hubungan kerja yang terjadi ialah tidak berdasarkan dari pihak pertama atau pengusaha saja. Sehingga mengenai hubungan kerja yang menyebutkan bahwa terdapat unsur-unsur mengenai pekerjaan, upah dan perintah, mengenai ketiga hal unsur dalam hubungan kerja tidak memenuhi unsur-unsur yang terjadi pada perjanjian kemitraan antara perusahaan transportasi online dan driver.Perlindungan yang didapati oleh pengemudi tertuang pada pasal 16 ayat 16 ayat (3) huruf h dan i yakni mendapatkan kepastian santunan jika terjadi kecelakaan, dan kepastian mendapatkan perlindungan jaminan sosial ketenagakerjaan dan jaminan sosial kesehatan sesuai dengan ketentuan peraturan perundang-undangan walaupun dalam penerapannya pelasksaanaan perlindungan yang diberikan dengan menggunakan syarat disaat pengemudi melaksanakan kegiatan pengangkutan.
As an innovative and practical means of payment, electronic money is expected to facilitate the smooth payment of mass, fast, and micro economic activities, and its development will help smooth transactions in public transportation such as toll roads, trains, or other fields of public transportation. . Trade in mini markets, food courts or car parks. Given the importance of this role, the government conducts efficient and effective transportation operations by building toll roads that use electronic money cards (e- money) for payments. Consumers must use e-money cards for payment transactions, and this payment system also has a weakness, namely that consumers feel disadvantaged, namely they are not entitled to security in the event of loss and damage to the e-money card. This research is a normative legal research with a written method. Legal materials in this study include primary legal materials, secondary legal materials, and tertiary legal materials. The legal material analysis technique used in this research is to use descriptive techniques followed by evaluation. The findings and conclusions of this study indicate that the use of electronic money (E-Toll) on toll roads is often problematic, contrary to the Consumer Protection Act (UU No. 8 of 1999) which is certainly very detrimental to consumers. , Because the e-money card is an unregistered card, if the e-money card holder is lost or damaged, there is no legal protection. If the card is lost or damaged, the bank is not responsible for re-issuing it. E-money card, e-money card holder has no legal remedies for loss and damage due to a legal vacuum.
The Civil Service Police Unit (Satpol-PP) is a government apparatus at the regional level which has the function to carry out Regional Regulations and Regional Head Regulations on the basis of Law 23 of 2014 concerning Regional Government. Then this was continued in Government Regulation Number 16 of 2018 concerning the Civil Service Police Unit. Therefore, considering the importance of the role of Satpol-PP in enforcing regional regulations, this 'research' aims to find out how the 'role of the police unit' civil service in Semarang City is in enforcing regional regulations No. 8 of 2009 concerning 'Supervision' and 'Control of alcoholic beverages. in the city of Semarang. The research method used is the normative juridical method with case studies on enforcement by the Civil Service Police Unit (Satpol-PP) in Semarang City whose data includes: data on cafes, restaurants, karaoke places and/or places where alcohol drinks do not meet the requirements as regulated in Regional Regulation No. 8 of 2009, there are still many restaurants that do not meet the requirements stipulated in the legislation. Therefore, the role played by the Civil Service Police Unit is by litigation, namely the enforcement process as stipulated in the Criminal Procedure Code and Administrative Sanctions in the form of administrative termination in the form of temporary suspension.
Every motorized vehicle that is operated and/or used on the highway must meet all technical requirements and roadworthiness requirements as stipulated by Law No. 22 of 2009 concerning Road Traffic and Transportation. The objectives of this study are to: 1) examine more deeply the implementation of Law No. 22 of 2009 concerning Road Traffic and Transportation on roadworthiness tests for public transportation vehicles in the jurisdiction of Semarang Regency, 2) Knowing the obstacles related to Implementation of Law No.22 of 2009 concerning Road Traffic and Transportation on roadworthiness tests in the jurisdiction of Semarang Regency. This type of research is field research and uses a normative juridical approach in obtaining data, where a normative juridical approach is carried out based on the main legal material by examining the concepts, principles, and legal theories as well as legislation related to the Act. Law No.22 of 2009 concerning Road Traffic and Transportation in the jurisdiction of Semarang Regency. The results of this study obtained a conclusion that: The implementation of Law No. 22 of 2009 concerning Road Traffic and Transportation on roadworthiness tests for public transport vehicles is in accordance with the provisions contained in Article 54 paragraph (3) regarding KIR testing of public transport vehicles. in the jurisdiction of Semarang Regency too has been implemented using a smart card where the implementation of a smart card is a substitute for a test book which is a policy of the Central Government through the Ministry of Land Transportation program.
