Artykuł stanowi omówienie konkretnego problemu jaki może powstać w trakcie próby wdrożenia rozwiązań telemedycznych w Polsce. Po pierwsze, ze względu na brak definicji legalnej telemedycyny zostaną przytoczone propozycje znaczenia tego pojęcia wysuwane przez doktrynę przedmiotu oraz organizacje międzynarodowe i pozarządowe, wraz ze wspólnym mianownikiem przedmiotowych definicji. Po drugie, zostanie omówione konstytucyjne prawo do opieki zdrowotnej, które zostało przewidziane w polskiej ustawie zasadniczej w kontekście wymogu równości w dostępie do opieki medycznej. Po trzecie, zostanie przedstawiona prognoza zapotrzebowania na świadczenia zdrowotne w Polsce, bazująca na odpowiednich dokumentach Głównego Urzędu Statystycznego. Po czwarte, zostanie omówione zjawisko tzw. wykluczenia cyfrowego wraz z podaniem jego powodów, skali oraz podstawowego kryterium. Artykuł zakończą konkluzje w przedmiocie rozważań, które zawierają autorskie stanowisko oraz postulaty de lege ferenda dla polskiego ustawodawcy.
The aim of this paper is to discuss the significance of the judgment issued by the European Court of Human Rights on 4 December 2018 in case Magyar Jeti Zrt v. Hungary in the light of the analysis of legal admissibility of placing hyperlinks on the Internet. First, introductory remarks focus on outlining ECtHR case law on the subject-matter of the analysis, with selected and most important theses being presented. Next, the facts of the case are presented, while relevant international and national standards regarding the responsibility for posting links on the Internet are highlighted. The above allows for a full and essence-focused presentation of the ECtHR’s position in the commented case. The article concludes with a concise and original summary focusing on the consequences and identified academic problems caused by the ECtHR judgment issued in case Magyar Jeti Zrt v. Hungary.
The article discusses the problem of the indeterminate defendant in European tort law systems and in the projects aiming to unify tort law in Europe, such as Draft Common Frame of Reference and Principles of European Tort Law. The given issue relates to a situation where there is a damage caused by one factor, yet upon available evidence one may indicate a few potential factors which might have led to the damage, but it cannot be ascertained which factor was the actual cause of it. The problem is addressed with reference to two scenarios. First, when there is a limited and known number of persons acting tortiously, each of whom potentially might have led to the damage, but only one of them had actually caused it. Second, when it is certain that one tortfeasor from the undetermined group of tortfeasors caused damage to some of the injured persons from the group of the injured persons, but it cannot be established precisely which tortfeasor caused damage to precisely which injured person. In comparative law analysis, one may find various attempts to deal with the given issue, which come from the balance of ratios given to different solutions, as well as the legal possibilities or obstacles in national tort law systems. The main possibilities are: all-or-nothing approach, joint and several liability, and proportional liability. Those solutions are discussed in article in more detail with conclusion that the bold proposition of proportional liability presented in Principles of European Tort Law seems to be the most appropriate.
The aim of the article is to prepare an analysis in order to formulate propositions regarding the digitalisation of Polish criminal proceedings as regards the administration of justice. These hypotheses would have merited consideration even pre-pandemic, but they demand even more attention as a result of the pandemic. The pandemic has served to highlight the pre-existing necessity to adapt criminal law to the latest observable technical and technological advances. In light of the above, the first issue to be analysed concerns the conditions, procedures, and possibilities surrounding the collection of evidence electronically, taking into account the most recent relevant guidelines of the Council of Europe. The second issue to be examined will be the adaptation of criminal procedures, including Polish, to the standards stipulated in the Convention of the Council of Europe on Cybercrime of 23 November 2001, in light of national norms regarding evidence gathering. The third issue that will be assessed in this study will be the benefits, risks, or potential of the application of artificial intelligence algorithms in criminal procedure. The consideration of each of the three areas will have regard to the present global pandemic. The article concludes with a concise summary containing the authors’ conclusions and propositions de lege ferenda.
