The general international standards are being discussed in this article, as well as more relevant ones concerned with the problem of sexual exploitation and child abuse. Further, the article discusses a growing understanding of children"s exposure to violence, strengthened commitments to secure their safety and protection, and significant international implementation efforts to mobilize support for prevention and response and to help change attitudes and behavior which condone violence against children. With the fast development of the internet and online social networks, the article ends with a conclusion in identifying criminal law benchmarks based on the previously identified general international standards.
International human rights instruments specifically dealing with protection of women from violence, include the UN Convention on Elimination of All Forms of Discrimination against Women (CEDAW) and the Council of Europe Convention on protection from violence against women and domestic violence (Istanbul Convention), provide enhanced protection for women from all forms of mental and physical violence and maltreatment. These conventions pose international obligations to state parties to protect the rights of women that are victims of violence including the right to security of person. With respect to violence against women, the article analyses the scope of application of the right to liberty and security of person, by discussing also the possibility of the use of the right of security of persons to the action of other individuals with respect to violence against women, in particularly the state obligations related to domestic violence.
This article examines trafficking in women from a human rights perspective and through the gender based lenses. Thus it concludes that prosecution and protection as preconditions for successful fight against trafficking in women lies on enacting of laws that are in line with international standards, implementation of those and successful prosecution of traffickers. Furthermore, it points out that protection of victims is an important and integral part of the process of prosecution of traffickers and that it should be based on human rights principles as stipulated in international legal instruments and jurisprudence. INTRODUCTIONThe fight against trafficking in women, as a complex phenomenon, has been difficult but dynamic. It involves responses on international, regional, and national levels. There have been a number of strategies and policies targeting trafficking in women, adopted and implemented world globally, in order to eradicate this practice.
