Este texto hace una síntesis de los principales argumentos encontrados en la doctrina y jurisprudencia nacional e internacional que se esgrimen a favor de una mayor exigibilidad de los derechos económicos, sociales y culturales. Se profundiza en el concepto y fundamento de estos derechos, para a continuación repasar algunos ámbitos de exigibilidad: la Constitución, las normas internacionales, la doctrina y labor de las Instituciones de Derechos Humanos, y las declaraciones de Naciones Unidas. Para concluir, se aportan ejemplos de algunos tribunales que han entrado a conocer acerca de los derechos DESC.This text is a summary of the main reasons found in the legal doctrine and national and international jurisprudence to justify a greater enforcement of economic, social and cultural rights. It analyzes the concept of such rights, then go over some areas of enforcement: the Constitution, international standards, doctrine and work of National Human Rights Institutions and UN declarations. Finally, we provide examples of some courts that have come to know about ESC rights.
los continuos avances tecnológicos están trayendo consigo nuevas formas de almacenar, tratar y comunicar datos personales. Es necesario repensar el derecho fundamental a la protección de datos, y arbitrar mecanismos para adaptarlo a las nuevas formas de tratamiento. a nivel europeo se está trabajando en una nueva propuesta de regulación que consideramos, en general, muy apropiada para afrontar los nuevos retos en esta materia. para ejemplificar todo esto, en el presente estudio se plantea de forma detallada el caso de la computación en nube, sus principales características y algunas preocupaciones acerca de los riesgos potenciales que su utilización trae consigo.Rapid technological developments are bringing new ways to store, process and communicate personal data. We need to rethink the fundamental right to data protection and adapt it to new forms of treatment. there is a new «european» proposal for a regulation on the protection of individuals with regard to the processing of personal data, well suited to meet the new challenges. this study offers one example of this: the cloud computing, its main characteristics and some concerns about the potential risks that its use entails.
It is not true that the idea of the right to subsistence should not give rise to much controversy. In fact, social rights are not considered as fundamental rights by everyone. The aim of this paper is to analyze whether abstract social rights –and the right to subsistence in particular- should be put in constitutions and laws and if judges should be given powers to interpret them. The philosophical foundations and the content of the right are studied and five great challenges are presented, although the most powerful one is to focus on the social and political enforceability of the fundamental right to subsistence. Assessing the effectiveness of the right to subsistence, and the right to food particularly, is a complex issue. In the legal discourse, the question seems to be only suggested. Even when the Constitutions expressly recognize this right in some countries, its implementation faces many constraints. The progressive realization of ESC rights requires a complex interaction of policies and programs in a wide range of sectors and institutions.The scientific method used in this work is the legal-sociological method, regarding the understanding of the rules, the lack of them, their effectiveness, etc. Several methodological techniques have been used, such as social and legal analysis, legal deduction and induction, description and interdisciplinarity.
