Mining is one of the sectors that becomes an economic country’s support until now. Environmental issues is kind of difficult things and can’t even be separated from mining activities. Belitung island is as part of the largest tin-producing province in Indonesia that has been exploited since the 18 century. It also has experienced the environmental crisis as well as other mining areas has in Indonesia. This research is conducted as an effort to discover and unravel the problematic implementation of reclamation on the ex-tin mine’s land in Belitung Island by using a conceptual approach and legislative approach. Based on the observation’s result, it shows that the reclamation’s result in Belitung Island has not been successful. Data from PT Timah (Persero) Tbk about the reclamation in Belitung Island also shows that the realization is far from the plan. There is no target that achieved successfully every year, also there is no reclamation that reaches 50 percent, the maximum is only 25 percent in 2016. th
The objects of protection for intellectual property rights are vary greatly. Along with the development of science and technology, the objects of protection for intellectual property rifghts are developing from time to time. The objects are not only in one place. In Indonesia, the protected potential objects spread in various region. In some IPR branches, one of the reasons in because the communal ownership or the discover is no longer known, the IPR perspective cannot be protected, for example traditional knowledge or medicines. Some ofe the case include piracy of biodiversity from knowledge of traditional Indonesian medicines, namely the patenting of the brotowali plant by Japanes company. On the other hand, the statutory regulations on IPRs have minimal direct authority to local governments regarding IPR protection. Therefore, this normative research with laws and regulations approach exemines legal politics of local government authority in laws and regulations in the field of intellectual property rights. The result is from all of laws and regulations in the field of IPR, explicitly the authority of local government is only regulated in Law Number 20 Year 2016 Concerning on Mark and Geographical Indications. The rest is general in nature, for example the use of the term “state” in the Copyrights Law as the holder of traditional cultural expressions and copyright of works whose creatoris unknown. In fact, in the context of a rule of law, government authority derives from the prevailing laws and regulations, in line with the legality principle which is the basis in every state and government administration.
A region’s development planning should be carried out by referring to the strategic issues faced by the region. Thus, strategic issues become the basis upon which regional governments formulate their policies and work programs. This study examined how each region in Bangka Belitung Islands Province positioned strategic issues of ecology in its regional development planning. The current writers examined eight regional governments’ Regional Medium-Term Development Plan (RMTDP) documents; one of which belongs to the provincial government, while the rest belongs to the regency/city governments. This study found that ecological issues comprised an average 17.6% of the strategic issues in all of the planning documents, the highest of which was found in Belitung Regency’s planning document. In addition, the analysis revealed that the general focus of the strategic ecological issues was environmental damage, which was reported by three of the regions as a result of mining activities. This study provides an illustration of how each regional government is committed to take ecological issues seriously and include them in the strategic issues at the regional level.
Article 28H and section (4) of Article 33 in the Indonesian Constitution guarantee every citizen the right to a good and healthy environment with green economy. In order to implement it, the government issued Law No. 32 of 2009 on Environmental Protection and Management. The environmental regulations that became the umbrella act are facing challenges both in substance and implementation. Substantially, questions remain whether the green constitution has been incarnated in this regulation, and how it positions itself as the umbrella act for a number of regulations. In implementation, the challenges include the availability of legislations, from government regulations to technical policy, and its implementation in regional level, both at the provincial and regency levels in Bangka Belitung Islands. In each regime, the environmental issues have always been a part of strategic issues. This research focused on identifying environmental regulations from upstream to downstream, and how they are implemented in the context of environmental issues due to tin mining in Bangka Belitung. Data were obtained through literature review using statute and conceptual approaches.
