This study discusses the creation and realization of the principle of justice and the balance of limited partnership deed (commanditaire vennootschap) based on mudharabah contracts. The method uses normative legal research to analyze the principle of justice in contracts based on mudharabah contracts on the formation of limited partnership through literature review and exploring positive laws that apply. The results show the principle of justice and balance in forming a limited partnership using the mudharabah contract is reflected if one form of cooperation is based on a sense of help and its implementation fulfills the principle of fairness both in determining profits, losses, and relating to the termination of the cooperation agreement.
This study aims to analyze the process of electronically resolving business disputes through arbitration and the legal force of electronic arbitration awards. Using normative legal research that is used using the law approach and comparative law. The results show that dispute resolution can be done electronically through an arbitration institution. Electronic arbitration arrangements and procedures do not conflict with the provisions of Law No. 30 of 1999 concerning Arbitration and Alternative Dispute Resolution (UUAAPS). With respect to electronic arbitration awards, decisions that are valid and have legal force remain valid as long as conventional arbitral awards comply with the provisions of Article 54 paragraph (2) and paragraph (3) and have executive power as long as they comply with the provisions of Article 59 paragraph (2) of Law Number 30 of 1999 on Arbitration and Alternative Dispute Resolution (UUAAPS). Of course, to support the legal force of the Electronic Arbitration Award, Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions is needed as the legal basis for supporting the provisions of Article 4 paragraph (3) UUAAPS. The legal power of electronic arbitral awards based on the ITE Law, which is electronic which has the power of proof with other conventional documents, if at any time it is needed as evidence in related disputesPenelitian ini bertujuan untuk menganalisis proses penyelesaian sengketa bisnis secara elektronik melalui lembaga arbitrase serta kekuatan hukum putusan arbitrase elektronik. Menggunakan penelitian hukum normatif dipakai dengan menggunakan pendekatan perundang-undangan dan perbandingan hukum. Hasilnya menujukan bahwa penyelesaian sengketa dapat dilakukan secara elektronik melalui lembaga arbitrase. Pengaturan dan prosedur arbitrase elektronik berlaku sepanjang tidak bertentangan dengan ketentuan Undang-Undang No 30 Tahun 1999 tentang Arbitrase dan Alternatif Penyelesaian Sengekta (UUAAPS). Terhadap putusan arbitrase elektronik, dianggap berlaku dan mempunyai kekuataan hukum tetap layaknya putusan arbitrase konvensional sepanjang memenuhi ketentuan Pasal 54 ayat (2) dan ayat (3) dan mempunyai kekuatan eksekutorial sepanjang memenuhi ketentuan Pasal 59 ayat (2) Undang Undang Nomor 30 Tahun 1999 tentang Arbitrase dan Alternatif Penyelesaian Sengketa (UUAAPS). Tentu untuk mendukung kekuatan hukum Putusan Arbitrase Elektronik, maka dibutuhkan UU Nomor 19 Tahun 2016 tentang Perubahan atas UU Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik sebagai dasar hukum pendukung ketentuan Pasal 4 ayat (3) UUAAPS. Kekuaatan hukum putusan arbitrase elektronik berdasarkan Undang Undang ITE, yang merupakan dokumen elektronik yang mempunyai kekuatan pembuktian sama dengan dokumen konvensional lainnya, apabila sewaktu-waktu dibutuhkan sebagai alat bukti dalam penyelesaian sengketaa yang berkaitan.
