Purpose: The paper aims to determine the values of the main morphological characteristics of nanopatterns, which can be considered as the reference for use as surfaces of solar cells. Design/methodology/approach: The article uses an approach based on the definition of reference indicators of nanopatterns for solar cells by analysing the main parameters of solar cells and comparing them with the possible values of morphological parameters. Correlations of pore radius and visible wavelength, porosity and visible range, wavelength of de Broglie, nanopatterned layer thickness and charge carriers diffusion length, etc., are analysed. Compliance verification of morphological characteristics of nanopatterns with the specified criteria was performed on the example of porous silicon layers. Findings: The conducted research allowed to define the basic values of morphological parameters of porous nanopatterns, namely porousness, pore size (effective diameter), the thickness of the porous layer, and form factor. Reference ranges of morphological parameters of nanopatterns formed on the surface of semiconductors for applications in solar cells are established. Research limitations/implications: The article is devoted to the choice of optimal morphological characteristics of porous nanopatterns on the surface of semiconductors for solar cells. However, for solar cells, other types of nanopatterns can also be applied, for which it is also necessary to develop methods for selecting optimal parameters. Moreover, the prospect of research on this topic is to check the intrusion into a certain range of values of real nanopatterns formed on the surface of semiconductors. Practical implications: In the article the methodology allowing to choose optimal values of morphological parameters of nanopatterns for its application for solar cells is considered. Such studies are of great practical importance for the production of high-quality solar cells based on nanopatterned semiconductors. Originality/value: The article for the first time considers the choice of the nanopattern type and the ranges of morphological parameters in terms of quality assurance of the final product – the solar cell. It is determined that it is necessary to take into account such factors as porousness, pore size, thickness of the porous layer and roundness. A range of optimal values is selected for each of the indicators.
The COVID-19 pandemic has changed the lives not only of many people but also significantly affected the economy of individual countries and the world economy as a whole. The world has seen a reduction in production capacity due to the closure of borders between countries and the introduction of self-isolation. The coronavirus pandemic has disrupted the usual relationship between manufacturers and users and has made a major difference in transport. Such changes have been reflected in the regulation of relations regarding civil and criminal liability for offenses in the field of transport relations in a coronavirus pandemic. With this in mind, it is important to analyze the transformations of civil and criminal liability in the field of transport due to the Covid-19 pandemic. The work aims to analyze the civil and criminal liability in the field of transport relations due to the Covid-19 pandemic. The object of the study is a civil and criminal liability in the field of transport due to the Covid-19 pandemic. The subject of the study is the public relations that arise, change, and end during the prosecution of civil and criminal transport in the wake of the Covid-19 pandemic. The research methodology consists of such methods as the analytical method, historical method, method of analysis of legal documents, articles, and monographs, method of generalization, comparison, synthesis, and modeling. The study will analyze the changes that have taken place in the field of transport, namely the peculiarities of civil and criminal liability for violations in the field of transport during the Covid-19 pandemic, as well as clarify the problematic issues of prosecution in the field of transport and controversial aspects pre-trial settlement of conflicts by the parties. The research also identified the main trends in the transport sphere in the context of the Covid-19 pandemic and explained what changes need to be made to establish a mechanism for civil and criminal liability in the field of transport due to the Covid-19 pandemic.
The investigation reveals shortcomings in the arguments of the Constitutional Court of Ukraine on the recognition of article 366-1 of the Criminal Code as not being in conformity with the Constitution, in terms of:(a) the court's lack of authority to criminalize socially dangerous acts; (b) lack of argumentation on the absence of social harm in the non-submission of a declaration and in the presentation of inaccurate information; (c) positive foreign experience; (d) conformity of article 366-1 of the Criminal Code of Ukraine with the principle of the rule of law. The article employs a set of legal research methods, including terminological, systemic-structural, formal-logical, and comparative-legal. It is stressed that:(a) the criminalization of a socially harmful act is a matter for the legislator, not the Constitutional Court of Ukraine, to decide; (b) the decision does not present or refute any argument on the element of social harmfulness relating to the non-submission of a declaration and the declaration of inaccurate information. On the basis of the investigation, it has been concluded that the decision of the Constitutional Court on the recognition of article 366-1 of the Criminal Code does not comply with the Constitution and has not been sufficiently substantiated.
