В статье анализируются существующие научные представления о системе принципов российского финансового права, дается краткая функциональная характеристика принципов. В качестве составного элемента Общей части финансового права рассматриваются не все, а только уникальные принципы, присущие исключительно финансовому праву как отрасли права. The monograph is devoted to the most urgent problems of the theory of sources and forms of financial law that require a new understanding in modern legal reality. The work was prepared by well-known scientists in the field of financial law science. Special attention is paid to the content and limits of constitutional regulation of financial legal relations, constitutional norm control, the history of the formation of forms and sources of financial law, methodologically significant categories of financial law. The problems of establishing legal institutions and sub—branches of financial law, as well as complex legal entities - banking law, insurance law, currency law - in regulatory legal acts are investigated. The issues of formation of sources of legal regulation of money circulation and settlements, banking activities are considered. The issues of sources of international financial law are revealed and the correlation of national and international financial and legal regulation is determined. It is intended for researchers of research organizations, university professors, practitioners, students of law and financial universities, as well as anyone interested in the subject of financial and legal science.
The paper provides the results of the analysis of the acts of the President of the Russian Federation, namely: decrees, orders, annual messages, affecting the budgetary issues. Presidential decrees have been systematized depending on the regulation of relations developing regarding budget expenditures and budget revenues, budget balance, budget structure and budget system, inter-budgetary relations, budgeting process. Depending on the degree of certainty of the addressee (addressees) the author examines decrees-instructions to specific state authorities, as well as decrees addressed to an indefinite circle of persons. The paper classifies Presidential Orders depending on their functional purpose and subject of regulation. In budget law, the Orders of the President of the Russian Federation perform the function of a regulator of material and procedural relations. Firstly, they formalize Instructions of the President of the Russian Federation to the Government of the Russian Federation at the stage of drafting the budget, and, secondly, they establish the spending objectives of the Reserve Fund and other budget allocations intended for financial support of the powers of the Head of State. By means of Orders, the composition of participants of the budgeting process can be specified, and the Orders themselves formalize the participation of the President of the Russian Federation in budget planning, making him a «co-author» of the budget law. The opinion is substantiated concerning inclusion of the annual Message of the President of the Russian Federation, fixing the goals and forecasting the socio-economic development of the state, in the system of sources of budget law. The author opines that adoption of acts by the Head of State in the budgetary sphere makes it possible to promptly regulate relevant public relations and determines the vectors of its development, ensuring stability of the system of public power and State integrity.
The relevance of the research topic is caused by the fact that the agro-industrial complex has a significant impact on the state of the environment. The agro-industrial complex is the most important element of the economic life of the absolute majority of countries. Its functioning is objectively necessary - enterprises that are part of the agro-industrial complex provide society with food and a number of important goods made from agricultural raw materials. The work of the agro-industrial complex also has the other side of the coin. Mechanization and automation of production lead to a quantitative and qualitative deterioration in the state of land, water and air resources. The purpose of the study is to highlight the environmental problems of the agro-industrial complex, to formulate proposals for their solution. The methodological basis of the study was scientifically grounded integrative legal thinking. The conclusion is made that the regulation of relations arising in the process of functioning of the agro-industrial complex is ensured through the application of social and technical norms. Environmental quality standards are of particular importance for solving environmental problems of the agro-industrial complex. They should be scientifically based and binding on all subjects of law.
The article provides a brief overview of certain areas of financial and legal research, whose subject matter is various aspects of protecting the rights of consumers of financial services. In the course of the study, the authors analyzed monographs and publications in Russian scientific journals. The Russian scholars paid special attention to digitalization processes and external adverse factors associated with the COVID-19 pandemic, which increased the vulnerability of consumers of financial services. The authors have emphasized the intersectoral and interdisciplinary nature of most scientific works and their possible systematization on two grounds: the first is segments of the financial market and the types of financial services corresponding to them; the second is the forms (methods) of protecting the rights of consumers of financial services.
