Indonesia is a country with highest number of smokers in the world with high mortality. The dangers of smoking not only threaten active smokers but also passive smokers. Policies are necessary to protect and reduce its adverse effects of smoking. At the regional level in 2018, the Malang City Government passed a Regional Regulation that regulates Non-Smoking Areas (KTR). The realization and efforts to implement this regional regulation are the objectives of the research. Qualitative method is used, the focus of research is to determine the four indicators popularized by George Edward III. Determination of informants determined by purposive sampling. Primary data was obtained through in-depth interviews, observations, and related document studies. The data analysis technique uses an interactive model according to Miles, Huberman & Saldana. Regional Regulation Number 2 of 2018 in Malang City in its implementation has not run effectively, yet the harmonization of this Regional Regulation with the Mayor's Regulation is the main obstacle. The development of smoking area facilities has not been maximized and the socialization of this regional regulation is still limited to policy implementers.
This article aims to describe the innovation of population services and public services in East Java Province by taking locations in two major cities in East Java Province. Try to identify and explain determine innovations in population services and civil registration in East Java by taking the focus of the object of two cities, namely Surabaya City and Malang City, East Java, Indonesia. The method used in this research is descriptive qualitative using three stages, namely observation, interview and documentation. Observations were made by observing the process of population services and civil registration in both cities, while interviews were conducted with officers and stakeholders related to population service innovations and civil registration. documentation is done by collecting data from supporting reports from the service of population and civil registration as well as literature related to the topic. The results have been found that the City of Surabaya and the City of Malang have made innovations in the management of population services and civil registration. The strategy used is almost the same, namely by facilitating services to the community, so that people get easy and fast services in the field of population and civil registration. There are five innovation criteria in population services, namely process innovation, method innovation, product innovation, conceptual innovation and technological innovation.
Indonesia pada dasarnya memang merupakan negara hukum. Penegakan hukum dalam perkara-perkara sengketa Tata Usaha Negara juga harus berlandaskan hukum. Akan tetapi dalam suatu perkara tertentu terdapat adanya perbenturan antar kompetensi di dalam sistem peradilan dan sistem hukum di Indonesia. Salah satunya adalah dalam perkara nomor 533/K/TUN/2017 di mana melibatkan unsur pidana dan unsur tata usaha negara. Kesalahan (schuld) dari terpidana menyebabkan aparatur sipil negara terkena pemecatan. Prosedur pemecatan yang kurang tepat menjadi unsur keberatan dalam pemecatan dalam sengketa tata usaha negara ini sekalipun unsur kesalahan (pidana) secara jelas terbukti. Tujuan penelitian ini untuk mengetahui dan menganalisis dasar penentuan kaidah dalam sistem peradilan. Penentuan kaidah memerlukan analisis mendalam terhadap filsafat hukum. Melalui metode penelitian yuridis-normatif maka akan dijelaskan pemilihan atau dasar argumen Mahkamah Agung lebih menekankan aspek substantif daripada formil di dalam menyelesaikan perkara ini. Kaidah hukum substantif lebih menjadi landasan lebih tinggi dari kaidah hukum formil dan dipertegas kembali dalam SEMA Nomor 1 Tahun 2017. Melalui teori tiga nilai dasar Gustav dapat diketahui bahwa pemilihan kaidah substansi ini memiliki pertimbangan aspek keadilan (filosofis) dengan memperhatikan peristiwa konkret (sosio-empiris) sehingga bermanfaat bagi negara dan masyarakat.
The research aim was measuring perception of students to equality of opportunity to get higher education at Tribhuwana Tunggadewi University. To meet the aim and collect the primary data, a questionnaire survey was held to 326 Tribhuwana Tunggadewi active students in the year of 2019 by simple random sampling. Data validation was with construct validity and Alpha Cronbach. The analyzed data was with a quantitative technique by Microsoft Excel and IBM SPSS 22. The research results measured from the prospects that most students perceived “yes” the admission pathways were diverse (M = 6); the admission phases were enough (M = 6); the information and requirements were clear (M = 6); the campus promotion got to school (M = 5); most students perceived admission opportunity to all class (M = 6); and most students perceived “no” ethnic discrimination when registering (M = 4). From the means equality, most students perceived “yes” the admission test was acceptable for all registrants (M = 6); the general test informed the score to the registrants (M = 6); the registration rules equal for all registrants (M = 6); the general test informed schedule before (M = 6); the admission considered achievements, interests, and talents (M = 6); and the applicants passed the general test accepted (M = 6). The research results had a measurement score if it was true significant that the mean of perception equals to 6 of the undergraduate students perception.
