<p>Syuro has an important role in Islam. As a decision-making mechanism, syuro plays an important role in every aspect of human life. Syuro is also understood as an appreciation of the freedom of expression of human beings in social relations. Therefore, the true syuro in Islam is not always identical to politics. It's just that, as a large part of human life, the role of politics in social life is also very important. As a means of upholding shari'a, politics is considered capable of providing good legal certainty for human social life and also in determining a political leader. Due to these interests, the role of syuro in politics cannot be avoided. Syuro in Islamic politics cannot be directly equated with the practice of deliberation in the current political phenomenon. In addition to the uniqueness of the concept that emphasizes respect for human dignity in terms of his freedom, syuro in Islam places great emphasis on scientific authority, syuro in Islam is also not always identical with the concept of majority rule, because the basis is sharia. So if the majority opinion is contrary to what is in sharia, then the majority opinion is not acceptable.</p>
This paper aims to provide a comparative analysis between the concept of insurance and the concept of takaful from an Islamic perspective. The method used in this paper is the study of libraries, in which the author seeks to find, summarize, analyze and ultimately deduce from various authoritative data sources. Insurance is a non-bank financial institution that offers protection against difficulties to the public. By paying dues or premiums that have been determined, the public has the right to make a claim that will be reimbursed by the insured party several funds that have also been determined. The insurer states to bear all risks that occur in the future. Therefore, all dues paid will be covered and managed by the company. However, it turns out that attitude is detrimental. Because the claim from the customer is not filed, then the customer's money is forfeited and entirely belongs to the company. In addition, the management of funds that are unclear and even almost unknown to customers makes this insurance practice illegal because it contains gharar and usury.
Abortion has generally been considered cruel, inhumane, and contrary to religious law and doctrine. However, the law of abortion in particular needs to be studied in more depth, as there are various causes, not only one form, that underlie it.This paper examines how abortion is done due to indications of fetal defects according to Islamic law. This research is a type of normative legal research that is prescriptive, because this research is a scientific research to find the truth based on scientific logic from the side of law, using the approach of fiqh. The types of legal materials that the author uses are primary and secondary legal materials. The primary legal materials include the Qur'an, al-Hadith, and the fiqh books, while the secondary legal materials used are the literature that is in accordance with the object of study including Law no. 36 Year 2009 on Health. Data analysis technique is used with deductive logic. Based on the study findings, the conclusions are, first, the law of abortion is haram though in various levels in accordance with the development of fetal life. Second, Medical advancement has now been able to detect fetal damage before the age of four months. It is not considered accurate if the doctor makes the assumption that after birth the baby will experience a blemish such as blindness, deafness, or mute and that those defects are considered a cause that permits abortion. Such defects are actually disabilities that have been known in the wider community throughout human life and carried by many people. Third, nevertheless, in the first 40 days, and before the age of the fetus reaching 120 days in the womb, the fetus is in the phase of a clot of flesh and blood. If a trusted doctor determines that the fetus has a malformed disability and it cannot be cured, and if left alive, the future conditions will become a problem for him and for his family. The heart is an organ of the human body that plays an important role in blood circulation and is one of the bases for knowing the physical health of every human being. The heart rate monitoring system used by health institutions is quite good but it costs a lot of usages. In the design carried out by researcher produced a tool that can detect all ages process for 60 seconds. The results after heart rate detection provide condition information and BPM (Beat Per Minute) of the heart. This tool uses a pulse sensor as a heart rate detector with a 3x4 keypad as input for age data and is displayed on a 16x2 LCD with the results of heart conditions and BPM. During testing, the researcher tested approximately 20 respondents as counted tests to put their data in a comparison table. From the results of tests that have been done are classified into two systems testing. The final result of manually testing produces a relative error percentage of 2.40%. While testing, by comparison, using a stethoscope produces a relative error percentage of 1.65%.
The problem of gender equality in Islam often uses theological grounds to include the hadith proposition as a tool of legitimacy. Especially in the case of the household, the argument of curse in the relationship of husband and wife is used as the basis for accusations of obtaining domestic violence by the husband to the wife. As if Islam would allow a husband to wife's violence if they were not willing to serve their sexual desires. This paper aims to answer these assumptions by analyzing the argument of the curse by using the method of critical criticism from the perspective of language or can also be called the bayani method, namely the method of analyzing the meaning of meaning in the argument of fiqh law. The result is that there is an error in understanding the meaning of the hadith caused by a weakness in understanding the meaning in Arabic which is the language of the hadith. Therefore, finally bring conclusions that are less proportional in understanding the propositions and facts. The hadith is a guide for all Muslims and there is no need for doubt in the study of hadith. The development of the modern era certainly has its own influence, especially in the scientific field of hadith. As Muslims of course we are all required to be able to fight in all fields, especially in the field of hadith science. The theoretical uptake and applied form of the Fatima Mernissi methodology of thought have created an important issue to study. His action in terms of knowledge has given rise to new problems for the hadith scientists in the field of feminism. This research aims to examine how the forms of hadiths are based on Fatima Mernissi's ideas and thoughts. The problem of misogynist traditions is a form of contemporary research that must be discussed, especially regarding the reconstruction of understanding of misogynistic traditions. Few things are important in the study of misogynistic traditions, where the existence of this hadith has created problems for making new facts in the world of feminism. The new fact is nothing but the formation of new weapons in terminating the acceptance or rejection of the hadith. Furthermore, the discussion of this research will be accompanied by the tarjih method in order to arrive at the correct conclusions. Whether the misogynistic hadiths are hadiths that show that Islam discriminates against women or not. The purpose of this study is none other than a study for proving that misogynistic hadiths are not an expression of the hadith denied by Fatima Mernissi to the Muslims' grip which is expressed in the Qur'an and al-Hadith.
