Resumo. O presente artigo tem como objetivo descrever os aspectos gerais sobre a normativa brasileira envolvendo internações psiquiátricas, destacando, adicionalmente, alguns pontos teóricos que podem ajudar a entender melhor as razões dos entendimentos atuais sobre internação de pessoas acometidas de transtornos mentais. Será dada ênfase na Lei 10.216 de 2001 (Lei de Reforma Psiquiátrica) por ser a principal norma brasileira em vigor a respeito do assunto. Procura-se frisar a importância das iniciativas científicas, políticas e normativas para o caminho em que se busca vencer a estigmatização e a segregação, na luta pela realização plena do ser humano que carece de atenção em saúde mental.Palavras-chave: Saúde Mental; Hospitalização; Legislação; Jurisprudência, Brasil.Abstract. This article aims to describe the general aspects about the Brazilian legislation involving psychiatric hospitalizations, highlighting in addition some theoretical points that can help us better understand the reasons for current understandings about internment of persons suffering from mental disorders. Emphasis will be given in the law n° 10216/2001 (Psychiatric Reform Law) as the main Brazilian rule in operation on the subject. We seek to stress the importance of scientific, political and legislative initiatives for the way in which it's sought to overcome stigmatization and segregation, in the struggle for full realization of the human being who needs mental health care.
This study examined some basic health care approaches toward human needs, with a particular focus on nursing. We aimed to incorporate these approaches into the discussion of the mental health of adolescent offenders who consume alcohol. We discuss specific needs of the delinquent group, critique policies that prioritize coercion of adolescent offenders, and the role that nurses could play in the sphere of juvenile delinquency.
Resumo: O objetivo geral deste estudo é compreender como o direito à saúde mental pode influenciar no processo criminal em que é acusada a pessoa com transtornos mentais e que, conforme as definições legais a respeito, o entendimento dos fatos e autodeterminação da conduta, seriam possíveis sujeitos à aplicação da medida de segurança. Trata-se de pesquisa descritiva documental, realizada com base na análise da normativa penal sobre medida de segurança e a base legal da Reforma Psiquiátrica. Por meio da análise foi possível perceber que é necessária uma maior aproximação das leis penais com a realidade jurídica atual das pessoas com transtornos mentais, com vistas a proporcionar um trabalho mais integrado entre judiciário e profissionais de saúde, e, consequentemente, um tratamento de melhor qualidade. Palavras-chave: Direito Penal; Saúde Mental; Psiquiatria Legal; Reforma Psiquiátrica; Medida de Segurança.Right to mental health and evolution of safety measure under the view of psychiatric reform Abstract: The aim of this study is to understand how the right to mental health can influence criminal cases in which the person with mental disorders is charged. And according to legal definitions on that, the understanding of facts and self-determination of conduct would be subjects of the possible security measure's application. It is a descriptive research paper that was made based on the analysis of the criminal rules on security measures and the legal basis of the Psychiatric Reform. Through the analysis it was possible to realize that we need greater approximation of criminal laws with the current legal reality of people with mental disorders, with the intention to provide a more integrated work between legal and health professionals, and hence a better treatment quality.
