The problem of the use of state property by partners needs to be studied in the perspective of legal expediency theory. after the Regulation of the Minister of Finance No. 115 / PMK.06 / 2020 on the Utilization of state property. Utilization of state property in practice, some are done by partners, such as what is the right to ownership of state assets and also the results of empowered utilization to increase state assets need to be analyzed in the perspective of utilitarianism legal theory. The research method used is normative juridical. The purpose of this research is to optimize the utilization of state property by partners.. The results showed that the utilization of state property by partners cannot be transitioned into property rights and must also be utilized productively to increase state assets. The right of utilization of state property is not essentially a property, so when using state assets, state property can only be used for productive assets, with the result of providing benefits to increase state assets. As a result, state assets are non-transferable when using state property.

The AFTA-China regional free trade is a new challenge. Indonesia is now entering the era of AFTA-China international competition. Whereas in free trade AFTA-China has joined through ACFTA (Asean China Free Trade Agreement), in the Framework Agreement on comprehensive Economic Cooperation Between the Association of South East Asian and The People's Republic of China (Asean-China). The Indonesian government and China will cooperate in the industrial sector, with the hope that the cooperation between the two countries, for Indonesia, can encourage Chinese investment in Indonesia, especially cooperation in industrial technology including trade. Labuhan Batu is a district located in the province of North Sumatra (Indonesia), where the regional potential is such as agriculture and plantations, facilities and infrastructure are quite superior and have great potential in responding to AFTA-China international competition, especially post-expansion with the hope of existing potential. the area is ready to compete in the international market.

Pada prinsipnya konsep dasar perdagangan bebas merupakan penghilangan hambatan-hambatan dalam  proses perdagangan internasional, namun yang menjadi isu hukum dalam kajian ini adalah bahwa suatu perdagangan bebas dalam skala sistem multilateral World Trade Organization  disingkat dengan WTO sedikit terkendala dan tidak berjalan dengan baik sesuai dengan harapan, sehingga mulailah suatu negara itu membentuk blok perdagangan secara regional misalnya ASEAN, AFTA, termasuk  ACFTA yang bertujuan mendapatkan keuntungan secara langsung dan meningkatkan kemajuan pertumbuhan ekonomi dalam skala regional dengan lebih berkembang serta meningkatkan kemajuan. Metode yang digunakan dalam tulisan ini berawal  dari hasil penelitian adalah menggunakan metode penelitian yuridis normative dan kajian yang dianalisis ini berawal sejak 1 Januari 2010, negara  China dipastikan telah bergabung dalam kesepakatan Asean China Free Trade Agreement (ACFTA), pada Framework Agreement on comprehensive Economic Co-opration Between The Association of South East Asian Nation and The People’s Republic of China  (Asean-China) dan telah  ditandatangani Presiden Republik Indonesia waktu itu Megawati di Phnom Penh, Kamboja pada tanggal 4 Novenber 2002, serta telah diratifikasi  melalui Keputusan Presiden No.48 Tahun 2004, dengan Undang-Undang No. 24 tahun 2000 tentang Perjanjian Internasional. Oleh karena itu, dasar hukum berlakunya kesepakatan perdagangan regional dalam ketentuan World Trade Organization  atau WTO diperbolehkan dalam pasal 24 GATT, dengan beberapa kebijakan yang dilakukan  pemerintah untuk melindungi industri dalam negeri terhadap  dampak negatif dari pelaksanaan perdagangan bebas regional, sesuai dengan prinsip transparansi, kejujuran dan harus ditetapkan dalam satu kaidah
