The usage of internet in humans activities causes a borderless world circumstance. There are a lot of people all over the world can take adventages of internet for their daily lives, but there are also some disadventages or bad impacts of internet itself,especially in online business activities, as it is wellkown as E-Commerce. In practice, E-Commerce activity is very close related to an agreement which has been regulated in Civil Law, and the implementation or application of this activity often causes disadventages or loses for other parties. This is what we call deed against the law. This deed against the law conventionally has been regulated inBurgerlijke Wetboek (BW), article 1365, but it is not explicitly regulated in Act No. 11 year 2008, wheras one of the provision which can be applied in E-Commerce in Indonesia isAct No. 11 year 2008. Such condition makes more disadventages or loses caused by deed against the law in online business activity, but so far Act No. 11 year 2008 has not accomodate these problems.
Transaksi bisnis secara elektronik (E-Commerce) di Indonesia menunjukkan perkembanganyang pesat dan memiliki pengaruh yang sangat besar terhadap perdagangan global. Pada praktiknya sering terjadi permasalahan yang berujung sengketa dalam e-commerce tersebut, tidakhanya antara pelaku usaha di dalam negeri tetapi juga tidak menutup kemungkinan sengketaterjadi dengan pelaku usaha di luar negeri seperti sengketa nama domain, karena sifat ecommerce yang tidak terbatas ruang dan waktu (borderless world). Salah satu upayapenyelesaian sengketa e-commerce saat ini yang menjadi pilihan para pelaku usaha yaitudengan mempergunakann mekanisme penyelesaian sengketa secara alternatif yang efektif,efisien, disertai biaya murah. Adanya e-commerce telah mengilhami dilakukannya penyelesaiansengketa secara elektronik pula. Salah satu mekanisme penyelesaian sengketa secara alternatif ini antara lain melalui cara arbitrase (online). Saat ini, ada berbagai lembaga arbitraseyang dapat digunakan dalam menyelesaikan sengketa e-commerce tersebut seperti BANI(Badan Arbitrase Nasional Indonesia), NAF, WIPO, SIAC dan sebagainya. Walaupun telah adaketentuan yang mengatur arbitrase dan pelaksanaan putusan arbitrase di atas, namun adabeberapa hal yang tidak bersesuaian antara peraturan satu dengan peraturan lainnta terkaitpelaksanaan arbitrase online di Indonesia.
This study aims to minimize the losses obtained by e-commerce businesses because of the risk of changes in demand and supply of products that are not balanced through communication strategies. The approach taken was a qualitative approach, a case study method and data collection with literature review, online journal research and observation of the problems that were the subject of research. Based on the result of research, e-commerce and electronic shopping transaction services made it easy for consumers and business people with its online payment system and practical business transactions.
The purpose of this study is to find out and analyze the legal actions that can be taken against perpetrators of spreading komputer viruses via email (cyber spamming) based on applicable law. The research is descriptive analytical, using a normative juridical approach, through laws and regulations related to information technology, then the data obtained are analyzed in a qualitative juridical manner. The results of the study show that the act of spreading komputer viruses via email (cyber spamming) can be applied to the provisions of Article 30 paragraph (2) in conjunction with Article 46 paragraph (2) of Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions, provided that it must be proven that the actions taken by the perpetrators fulfill the subjective and objective elements of the article. The conclusion obtained from this research is that the act of spreading komputer viruses via email (cyber spamming) is a violation of the law as regulated in the Electronic Information and Transaction Law and the perpetrators must be given legal sanctions according to applicable regulations. The impact of this research is that the government must always supervise the development of information technology and violations that occur so that they are always accommodated by existing regulations, besides that the public must always be careful in using internet-based information media.
The purpose of this research is to find out the brand communication strategy carried out by beauty e-commerce companies in managing the website and how it affects each visitor so that they have a good image. The study used a literature study method with the object of research was the online shop Sociolla and Beautyhaul. The results of this study are the importance of the company to have a good image to communicate brand identity with the trust of consumers and brand or partners. In Indonesia, businesses that specifically sell beauty products online are still relatively rare. Therefore, the company has a big task in conducting brand communication, especially on managing websites because consumers prefer the experience of trying beauty products when buying it directly. The Beauty E-Commerce will facilitate the business in terms of documentation and transactions as well as product offerings in person.
