○ Investors who exploit natural resources have the right to obtain benefits equal to the benefits obtained by government and indigenous peoples. • The EIA process must include all of these three groups of stakeholders if it is to be effective.
Globalization has placed Indonesia in a dilemma in creating the welfare of the people. Many legislations with liberal character are disallowed through the constitutional review by the constitutional court. The liberal character then becomes constraints for government to realize social welfare, thus harming the economic interest of people and contrary to the constitution (UUD 1945). Efforts to create welfare cannot be separated from state sovereignty in determining the economics welfare policy in the form of law. The State needs to adopt policies of recalibrating sovereignty to realize its objectives. Sovereignty is the essential requirement to be able to build pengayoman law character, ideology by Pancasila ideology and UUDNRI 1945. The legal substance of pengayoman law (protection and succor) will realize a balance between global interests and the interests of the nation. Pengayoman Law integrates the efficiency and freedom with fairness and welfare excellence. Also, the Pengayoman Law always opens the space to give a guarantee/partiality to the poor through social policies that are based on human dignity. Pesatnya perkembangan pasar modern saat ini berbanding terbalik dan bahkan menjadi ancaman bagi eksistensi pasar tradisional (pasar rakyat) yang merupakan motor penggerak perekonomian rakyat. Kontrasnya, pengaturan dalam produk hukum daerah justru berpihak pada pertumbuhan pasar modern dan mengesampingkan keberlanjutan pasar rakyat. Kajian ini bertujuan untuk menguji pengaturan mengenai pasar modern dan pasar rakyat dengan indikator nilai-nilai Pancasila. Penelitian ini sangat urgen dilakukan guna mengidentifikasi dan menyelesaikan problem hukum dalam pengaturan pasar modern dan pasar rakyat saat ini. Kajian ini menggunakan metode penelitian hukum normatif dengan pendekatan filosofis, pendekatan konseptual, dan pendekatan perundang-undangan. Hasil penelitian menunjukkan bahwa ada ketimpangan pengaturan yang terjadi dalam perumusan pasal per pasal pengaturan dalam produk hukum daerah. Ketimpangan tersebut berupa keberpihakan pemerintah daerah terhadap pasar modern dan lemahnya perlindungan terhadap pasar rakyat. Keberpihakan ini dapat dimaknai sebagai sebuah perubahan paradigma pembangunan yang lebih berorientasi pada liberalisasi perdagangan dibanding perlindungan terhadap pasar rakyat sebagai warisan budaya bangsa yang mencerminkan nilai-nilai Pancasila yaitu nilai kegotongroyongan, solidaritas dan kebhinekaan. Untuk itu, ke depan, regulasi yang mengatur mengenai penataan pasar modern dan pasar rakyat hendaknya dapat menyeimbangkan keduanya dan konsisten, koheren dan koresponden dengan nilai-nilai Pancasila.
Resettlement in the context of disaster management is a policy that has a broad impact on the affected community on legal, social and economic aspects. This article focuses on problems in implementing the resettlement policy for victims of the tsunami in South Lampung which occurred in December 2018. By using the socio-legal approach, the results of the study indicate that the resettlement policy for communities affected by the tsunami in South Lampung was carried out based on the Regent Decree No. B/613.1/VI.02/HK/2019. This policy was carried out as an effort to recover from the tsunami that occurred. In its implementation, this policy has an impact on at least three aspects of the life of the community concerned, namely the legal impact, social impact and economic impact both before, during the process, and after the construction of new housing. With regard to the legal impact, this resettlement causes legal relationships and issues regarding the rights and obligations of the victim to the building and land where he lives in the resettlement area as well as the rights and obligations of the victim to the land and building in his former place. On the social and economic impacts, problems arise with regard to access to education, employment, and the adjustment of conditions to the new environment in which they live. Therefore, resettlement cannot only be seen as a policy of rebuilding housing in a new place, but resettlement must also be seen as a holistic policy that focuses on rebuilding the livelihoods of the people involved in it, which in this context is a solution to the consequences, which occurs in both the legal, social, and economic aspects of resettlement
This article analyzes the implementation of the resettlement policy for the victims of the tsunami in South Lampung which occurred in December 2018. Using the socio-legal approach, the results of the research show that according to the Disaster Management Law it is stated that disaster management includes four stages, namely: establishment of development policies at risk of disasters, disaster prevention activities, emergency response, and rehabilitation. The first two stages are made before a disaster (predisaster), emergency response is carried out when a disaster occurs, and rehabilitation is carried out after a disaster. In the context of the tsunami disaster in South Lampung in 2018, one of the post-disaster policies carried out was resettlement. This policy was carried out based on the Regent's Decree No. B/613.1/VI.02/HK/2019. In this decision, it was determined that this resettlement policy was carried out in 4 predetermined sub-districts, namely Rajabasa District, Kalianda District, Sidomulyo District and Katibung District. In its implementation, this policy has an impact on several aspects of community life that are displaced, such as in social and economic aspects.
