The article considers the main aspects of the development of doctrines on personal incorporeal rights in European countries. The conceptual approaches of researchers to such rights have been analyzed. A comparative legal analysis of the legal regulation of personal incorporeal rights in European countries has been conducted as well. The trends and approaches to the ways of consolidating such countries in the system of private law have been studied.
Based on the analysis of scientific concepts and legal principles the author has provided the definition of information security, provision of information security in Ukraine and has characterized its components. The current state of legal regulation of the organization and activity of cyberpolice units of the National Police of Ukraine has been analyzed. Particular attention has been paid to the legal analysis of the tasks, functions and structure of the Cyberpolice Department of the National Police of Ukraine. Special attention has been drawn to certain shortcomings of Ukrainian legislation in the field of ensuring information security by the police, its compliance with the norms and standards of international law. Taking into account the specifics of the tasks, the author has provided characteristics of the functions of cyberpolice units in the information sphere, which should be divided according to the purpose into: 1) basic (external), which are focused on law enforcement and preventive aspects; 2) auxiliary (intrasystem), which are focused on promoting the implementation of basic functions, the introduction of appropriate management mechanisms within the system. It has been stated that the modern system of ensuring information security and cybersecurity in Ukraine should be one effective system, consisting of such mandatory components as legal, educational and technical. It has been concluded that in order to improve the legal principles for the organization and activities of cyberpolice units of the National Police in the field of ensuring information security and counteracting cyber threats, first of all, it is necessary to optimize the organizational structure of cyberpolice, reasonably distribute the functions (powers) between cyberpolice units and other subjects combating cyber threats in Ukraine, to create appropriate conditions for reaching a qualitatively new level of interaction between them and coordination of their activities in the field of ensuring information security in modern conditions.
The article focuses on the peculiarities of rendering the meaning of compound terms in the translation process with the help of word combinations without shift of meaning in the semantic structure. The research is based on the examples from English and Russian legal terminology. Taking into account the fact that legal terms form a part of literary language the classification is based on principles accepted and used in Phraseology. The examples analyzed in this paper reveal the difference between English and Russian compound terms in the lexical and grammatical structure. The author arrives at a conclusion that the semantic shift in legal terminology has an anthropocentric orientation. The dependence of the nature of the semantic shift on certain features of national cultures is shown. The results of the investigation provide for the material for the study of the features of the corresponding segment of linguistic worldview.
The current state of administrative and legal regulation of social relations in the sphere of protection and use of the animal world in Ukraine is analyzed. The meaning of the concept of “poaching” is revealed and its components are outlined. Taking into account statistical data, a detailed description of effective organizational and legal measures to counter poaching cases, which are used in the activities of the units of the National Police of Ukraine, the State Ecological Inspection, and other nature protection bodies of Ukraine, is provided. It is noted that poaching is one of the major threats to biodiversity and national ecological security of Ukraine. It is emphasized the need to involve the public in the organization of actions for the protection of the animal world, as well as in the process of planning joint preventive measures of protection nature, conducting information and explanatory work among the population on issues of preventing violations of administrative (nature protection) legislation. Attention is drawn to shortcomings in the Ukrainian legislation, which regulates relations in the sphere of protection and use of the animal world. Proposals are also made to improve the legal framework for the interaction of the water police and units of the State Environmental Inspection in the field of animal protection in the modern conditions of the introduction of the legal regime of martial law in Ukraine. Taking into account the positive experience of nature protection activities of law enforcement agencies and other state bodies of Ukraine, the main areas of improvement of the system of organizational and legal measures against poaching are highlighted. In particular, these are: the proper organization of state administration in the field of protection and use of the animal world; the strengthening the responsibility of citizens and officials for violating the basic requirements and rules of rational use and reproduction of the animal world; the presence of an effective organizational and legal mechanism for the implementation of the rights and obligations of users of animal world objects; the joint actions of the State Environmental Inspection and the Water Police regarding the protection, reproduction and use of rare and endangered animals; the keeping state records of animals and records of their production; the implementation of state and public control in the field of protection, use and reproduction of the animal world; the introduction of new organizational and legal forms and methods of interaction of authorized state bodies and other subjects of combating offenses in the field of animal protection, increasing control over the quality of their implementation; the development of legal eco-education and a system of crime prevention measures; the introduction of modern mechanisms of analytical and logistical support of law enforcement agencies.
