A través de los conceptos de la escuela Behavioral Law and Economics, este artículo explora, en el derecho colombiano, las razones que explican por qué la necesidad de un trato diferente en la protección del consumidor en el entorno electrónico, tanto desde la perspectiva de disminución de los costos asociados a la desconfianza, como desde la de elevar relativamente los conexos a las reclamaciones del consumidor, para lograr una compensación normativa que induzca conductas eficientes de costo y consumo.

The application of blockchain technology to contractual activity has led to a decrease in transaction costs, but also an enormous potential cost of judicial solutions that order reversal of the effects of smart contracts. This research addresses solutions, both from the perspective of updating the unforeseen theory and from clauses that are introduced to the legal smart contracts to allow reducing the costs associated with judicial decisions that declare an anomaly in the contracts.

This paper will explore the solution to legal-empties for the resolution of certain situations that occur where some evidential value is intended to be given to the conciliatory records or absence records of out-court legal conciliation hearings under the act 640 of 2001 in relation of matter of Private Law. For the solution of concrete cases shall be referred to the Law´s integrative method, under the idea that the same sources of direct, hard, auxiliary or soft-law solutions on disparate circumstances arise that may happen when the minutes will end up instrumentalized in judicial processes. This document constitutes a line of thought integrated another article already published in CES Law Review on cases of assistance to hearings of out-of-court conciliation in law, worrying already in this venue about the probative value and the utility of the documents that end up serving as minutes or records in the hearings.

En la medida que una sociedad avanza descubre paso a paso que la imaginación vincula a los hombres a través de la norma y que crear las fronteras entre las situaciones de propiedad de unos y otros individuos, puede llevar a dominios también en el mismo campo de la imaginación, surgiendo un sinnúmero de propiedades posibles que se afirman, no sólo sobre cosas que existen sensorialmente, sino sobre productos del pensamiento y del ingenio en el marco de la intangibilidad.
