This chapter anchors Cuba’s constitutional development in the cultural history of the region and world, starting with the struggles for Cuban independence from Spain, continuing with the 1930–33 revolution, followed by the successful Communist revolution in 1959, and lasting up to the present day, when a new series of reforms are currently being implemented. The chapter argues that the conception of rights and democracy enshrined in these texts, however related to regional and world historical events and trends, retains a distinctly Cuban notion of individual and collective rights. It concludes with an epilogue identifying positive aspects of the new reforms, new aspects that are problematic, and serious problems that are ignored.
