Around the world, parliaments, governments, civil society organizations and even individual parliamentarians are taking measures to make the legislative process more participatory. A key instrument of such measures is e-democracy. In the 1980s, a number of pilot projects on electronic voting and online discussions were introduced. However, only since 2000, with the active development of the Internet, has considerable interest in utilizing electronic initiatives to advance democracy emerge. Today, researchers warn that despite all the talk about “e-democracy,” the circle of actual decision makers is likely to remain as small as it has been heretofore. In this article, the author analyzes the pros and cons of electronic initiatives in the BRICS countries, Europe and the Russian Federation, and provides practical information for improvement. The author suggests that the next step needed to improve civil activity in filing legislative initiatives is the application of a regular mechanism to establish the possibility of organizing the process of civil legislative initiative nomination and the collection of signatures in electronic form, in particular via the Internet, with the possible use of crowd sourcing technologies.
The development of confidential-sensitive methods is expected to become a promising area for future research in data mining. Since the main task in retrieving data is to develop aggregated systems models, can we develop such models without access to accurate information in individual repositories? In today’s world, such an issue is becoming a key one, especially concerning the exercise of human rights on the Internet, since the very realization of such rights is related to data protection, on the one hand, and access to information, on the other hand. The need to maintain this balance is one of the key challenges law is facing in modern realities. In the article, the author reveals the importance of protection of such a right as access to geolocation and studies the influence of the right under consideration on the realization of other rights exercised by citizens on the Internet (in particular, the right to information).
Purpose. The purpose of the scientific article is to study the modern information society, as well as to consider the conditions for the development of global information and communication networks, the global information exchange system. The author has studied the current legal regulation of freedom of speech to achieve this goal. Methodology. The article applies general scientific methods of system analysis and synthesis, as well as private scientific methods: comparative, sociological. The use of methods of analysis and synthesis will determine the key scientific concepts for research. In addition, an institutional research method will be used. On its basis, in particular, the originality of the forms of regulation of the right to freedom of opinion has been revealed; specificity of regulation of restrictions of this right. The article concludes that the existing regulation does not correspond to the level of development of public relations. The fact that there are no legal instruments that can prevent the falsification of information in the media indicates that there are problems in ensuring the right of citizens to freedom of expression in cyberspace, which ensures the relevance of the study. Scientific and practical significance. Within the framework of the research, a complex scientific theoretical and legal analysis of the constitutional and legal category “the right of citizens to freedom of opinion” in cyberspace was carried out; a comparison of Russian and foreign legislation. Results. It was suggested that the concept of the right to freedom of opinion in cyberspace be structured into separate elements. Following the logic of the proposed classification, the author proposes the main directions of improving the legal regulation of this right. The significance of the study is made by proposals to improve Russian legislation in the sphere of securing the right of citizens to freedom of opinion, as well as further development of mechanisms for the realization of this right in cyberspace.
Due to the widespread internetization of public relations, the Internet has become one of the most important platforms for the implementation of civil rights and freedoms, including the freedom of expression. However, some users go beyond legitimate exercise of this right causing harm to others by their actions. Cyberbullying is one of the forms of such actions.The purpose of the article is to draw the line between lawful expression of a negative opinion and cyberbullying while there is no necessary legal regulation in this field in the Russian legislation. To achieve this goal, the authors study the social and legal nature of cyberbullying relying on Russian and foreign experience. The paper highlights two cases of mass cyberbullying that took place in Russia in 2018 and caused a major public outcry.The authors conclude that the line between cyber-bullying and implementation of the freedom of expression is the deliberate focus of the former on causing moral suffering to the opponent and its unilateral nature. In addition, the paper focuses on the need for self-regulation of citizens on the Internet in order to protect public morality, as well as filling the existing legal gap.17
