Hadirnya perusahaan peer to peer lending (P2PL) sebagai penyedia jasa pinjam-meminjam uang melalui jaringan internet di Indonesia diharapkan menjadi alternatif pendanaan bagi masyarakat, faktanya menimbulkan berbagai permasalahan. Salah satunya adalah masalah perlindungan konsumen yang sering diabaikan. Penelitian ini bertujuan untuk mengkaji gambaran umum penyelenggaraan usaha P2PL di Indonesia, bentuk pelanggaran hak konsumen dalam pelaksanaan industri P2PL di Indonesia, dan solusi untuk mengoptimalkan perlindungan konsumen dalam industri P2PL. Penelitian ini menggunakan metode yuridis normatif dan empiris dengan menganalisa peraturan perundang-undangan, jurnal dan data terkait pelanggaran hak konsumen dalam industri P2PL. Hasil penelitian ditemukan berbagai permasalahan dalam pelaksanaan industri P2PL di Indonesia dikarenakan terdapat kekosongan hukum terkait dengan perlindung-an konsumen industri P2PL di Indonesia. Solusi untuk mengatasi masalah tersebut adalah dengan membuat undang-undang yang secara spesifik mengatur tentang pelaksa-naan praktik P2PL di Indonesia beserta sanksi yang tegas bagi para pihak yang melakukan pelanggaran atas undang-undang tersebut. Consumer Protection Strengthening in the Peer to Peer Lending Business in Indonesia The presence of a peer to peer lending company (P2PL) as a provider of money lending and borrowing services through the internet network in Indonesia is expected to be an alternative funding for the community, but in fact this raises various problems. One of the problems is consumer protection which is often ignored by P2PL companies. This study aims to examine the general description of P2PL business operation in Indonesia, forms of violation of consumer rights in the implementation of the P2PL industry in Indonesia, and solutions to optimize consumer protection in the P2PL industry. This research uses normative and empirical juridical methods by analyzing laws and regulations, journals and data related to violations of consumer rights in the P2PL industry. The result shows that various problems in the implementation of P2PL industry in Indonesia because there is a legal vacuum related to consumer protection for the P2PL industry in Indonesia. The solution to solve this problem is to make laws that specifically regulate the implementation of P2PL practices in Indonesia along with strict sanctions for parties who violate the law.
This article aims to examine the implementation of the Regulation of the Minister of Transportation No.18 of 2020 concerning Transportation Control in the Context of Prevention of Covid-19 (“MoTR No.18/2020”) as amended by Regulation of the Minister of Transportation No.41 of 2020 which serves as a guideline for infrastructure providers. transportation such as managers of terminals, stations, seaports and airports in implementing health protocols and transportation control. This research combines normative juridical law research methods and empirical legal research. Normative legal research is carried out by taking an inventory of related laws and regulations, journals, other encyclopedias related to the topic of this research. Meanwhile, empirical legal research was conducted by conducting interviews with the management of PT. Angkasa Pura II (Persero) Kuala Namu and direct observation at Kuala Namu Airport. The data obtained will then be analyzed qualitatively and deductive conclusions are drawn. The results obtained, that there are still some discrepancies in the application of health protocols properly and correctly due to lack of awareness to carry out health protocols and the absence of strict sanctions and supervision for violations of these
