<p><em><span lang="EN-US">The principle of marriage is a contract to justify the relationship between men and women, which between the two is not mahram. Viewed from a legal standpoint, marriage is a sacred and noble contract between men and women which is the legitimate status of husband and wife and is condemned to sexual relations with the aim of reaching a sakinah, full of love and virtue family. This article uses normative juridical research. Regarding legal marriage according to Article 2 paragraph (1) of Law Number 1 of 1974 concerning Marriage, each marriage is recorded according to the applicable laws and regulations. Besides that, it is associated with Article 2 paragraph (2) Government Regulation Number 9 of 1975 concerning the Implementation Regulation of Law Number 1 Year 1974 concerning Marriage which states that the registration of their marriages which according to their religion and belief except the religion of Islam, carried out by the Official Registration Officer Civil Registration and Population as referred to various legislation concerning the registration of marriages. Interfaith marriage is a violation of Law Number 1 of 1974. This can be seen in Article 1, Article 2 Paragraph (1) jo Article 8f of Law Number 1 of 1974 concerning Marriage. In the explanation of Article 1 mentioned: "As a country based on Pancasila, where the first principle is the One Godhead, then marriage has a very close relationship with religion / spirituality, so marriage not only has an element of birth / physical, but an inner / spiritual element also has an important role. Forming a happy family which is the purpose of marriage, maintenance and education is the rights and obligations of parents. Then Article 2 Paragraph (1) jo Article 8f explains that marriage is legal, if it is carried out according to the law of each religion and its beliefs, then there is no marriage outside the law of each religion and that belief.</span></em></p>
Penyelesaian perkara perceraian melalui mediasi akan mengubah kebiasaan berperkara di pengadilan melalui litigasi atau gugat menggugat. Para pihak penggugat dan tergugat harus memahami bahwa mediasi adalah perundingan para pihak yang terpimpin dan terorganisir oleh penengah yang netral dan imparsial yang dinamakan mediator. Cerai tanpa kendali akan merugikan bukan saja kedua belah pihak tetapi terutama anak-anak, keluarga dan masyarakat. Seadil-adilnya putusan yang dijatuhkan hakim, akan dianggap dan dirasa adil oleh pihak yang menang. Lain halnya dengan perdamaian, hasil perdamaian yang tulus berdasarkan kesepakatan bersama dari pihak yang bersengketa. Permasalahannya, bagaimanakah pentingnya pemberdayaan penyelesaian perkara perceraian melalui mediasi di Pengadilan Agama. Metode penelitian yang digunakan yaitu yuridis normatif. Asas-asas hukum menampakkan diri ke permukaan melalui aturan hukum. Asas hukum juga dapat mengalami perubahan, perubahan asas hukum sangat lambat dibandingkan dengan peraturan hukum. Penyelesaian mediasi di Pengadilan Agama dapat mengantarkan para pihak pada perwujudan kesepakatan damai yang permanen dan lestari, mengingat penyelesaian sengketa melalui mediasi menempatkan kedua belah pihak pada posisi yang sama. Fakta di Pengadilan Agama bahwa tidak semua hakim mempunyai bakat dan keterampilan dalam melaksanakan tugas sebagai mediator terutama yang belum pernah mendapatkan pelatihan secara profesional. Ruangan mediasi yang kecil dengan fasilitas minim seperti kursi dan penataan ruangan yang belum memenuhi syarat ruangan mediasi sehingga mempengaruhi hasil dari mediasi.
Article 3 (2) Regulation of the Supreme Court of the Republic of Indonesia Number 1 of 2016 concerning Mediation Procedures, Case Examining Judges in the consideration of a decision must state that the case has been pursued peace through mediation by mentioning the mediator. The court is not only tasked with examining, trying, and resolving cases it receives but also seeks to reconcile the parties. The court, which has been impressed as a law enforcement and justice institution, now appears as an institution that seeks peaceful solutions for the parties. The implementation of Regulation of the Supreme Court of the Republic of Indonesia Number 1 of 2016 concerning Mediation Procedures in Courts can be an eff ort to resolve civil disputes so that the settlement of civil disputes through mediation is the main choice. The research method used is normative legal research which includes research on legal principles which is very basic in guided law. The nature of the research carried out is descriptive, namely research that describes and explains in clear and detailed sentences. The data used are secondary data obtained from literature, consisting of primary, secondary, and tertiary legal materials. Processing and data analysis used qualitative methods. The defi nition of mediation according to the Religious Courts in Indonesia and the Syari’ah Courts in Malaysia is the eff ort of the judges and courts to reconcile the parties so that the divorce process does not continue at the next trial. When the mediation process was carried out at the Indonesian Religious Court and the Syari’ah Court in Malaysia, there was a similarity, namely the mediation process was carried out at the fi rst trial and it was an obligation for the disputing parties in a divorce case to take mediation. according to the procedure for the appointment of mediators at the Indonesian Religious Courts and the Syari’ah Courts in Malaysia and the appointments of these mediators are both made by the judges.
