Introduction: in the context of the implementation of the declared technological modernization of the EAEU economy, the issue of developing the legal framework for the integration in the field of science, technology and innovation, and especially the issue of developing a system of its legal principles, is being updated. The purpose of the study is to develop a comprehensive conceptual understanding of the nature, system and functions of the legal principles that are the core of the legal regulation of the integration cooperation of the EAEU member states in the field of science, technology and innovation. The objectives of the study are the following: 1) to relate the legal principles of the regulation of scientific and technological integration with the principles of the Eurasian integration in general; 2) to carry out a consistent analysis of the degree of consolidation of the principles of scientific and technological integration in Union law; 3) to carry out the doctrinal classification of the principles. Methods: general scientific methods (system, structural and functional), specific scientific methods (comparative legal, dogmatic legal). Results: a classification of the legal principles of scientific and technological integration is proposed, the system of which includes a subgroup of general principles, as well as a subgroup of industry (structural-institutional, integration-legal and organizational) principles. Conclusions: the systematized legal principles are conceptualized as the key legal tools for managing integration processes in the field of science, technology and innovation, the formal consolidation of which will serve as a factor for expanding and deepening the regional scientific and technological integration of the member states.
Аннотация. В статье рассматриваются многообразные аспекты соотношения международного права и международной морали в контексте их исторического развития. Автор выдвигает подход, согласно которому мораль и право должны анализироваться как взаимодополняющие друг друга нормативные системы, регулирующие международные отношения. Большое внимание уделяется анализу моральных начал современного международного права, а также значению международной морали для перспектив эволюции международного права в условиях глобализации. Ключевые слова: международное право, международная мораль, глобализация, двойные стандарты, плюрализм, справедливость, права человека. Abstract. The present article deals with regarding varied aspects of correlation between international law and international moralityin the context of their historical development. Author suggests the approach in accordance with it the moral and the law should be analyzed as supplementing each other normative systems regulating international relations. Much attention is paid to analyzing the moral foundations of international law and to significance of international morality for further perspectives of its evolution in situation of globalization.
Аннотация. Статья посвящена обсуждению вопроса применимости понятия «правовая политика» к международному праву и международно-правовой системе. Большое внимание уделяется сопоставлению понятий «правовая политика», «политика международного права», «прогрессивное развитие международного права». Автор анализирует международноправовую политику как объективное международно-правовое явление, раскрывает ее цели и субъектный состав. В статье обосновывается вывод о том, что концепция международно-правовой политики должна основываться не только на уточнении сущности международного права, но и на анализе современных проблем его развития, связанных с его фрагментацией. Article is devoted to discussion on issue of applicability of the notion 'law policy' to the international law and the international legal system. Much attention is paid to comparison between such notions, as law policy, politics of international law, progressive development of international law. Author analyzes the international law policy as an objective international legal phenomenon, showing its aims and subject structure. Article gives proof of conclusion that the conception of international law policy should be based not only on giving a more precise definition of international law nature but also on analysis of current problems of international law development closely associated with fragmentation of the latter. Aim to consider the possibilities and prospects for the formation of interdisciplinary meta-reflection in comprehension of religious and mystical experience. Using the methods of critical philosophical reflection and dialectical logic, the authors analyze the specifics of the diversity of disciplinary approaches and interpretations of religious and mystical experience. At the same time, special attention is given to the factors of interdisciplinary interaction that contribute to the leveling of disciplinary and interpretation differences, which is necessary for the synthesis of new knowledge. Also, authors explain the prospects for the development of meta-reflection of a multidisciplinary space, where there are zones of interdisciplinary interaction. The logic of the study made it possible to draw conclusions about the prospects and advantages of interdisciplinary synthesis, which goes through synergy, contributing to the clarification of the archetypes of Christian mysticism and other religions.
