Purpose-The research aims to investigate the realization, the governmental role, and the existence of current corporate social responsibility (CSR) model that has been operated in West Aceh District. Design/Methodology/Approach-The data were collected through two ways: document studies (library research) on legal provisions governing CSR and through field research (field studies) conducted by interviewing persons in West Aceh District. Findings-The implementation of CSR is based on the Regulations Number 40 year 2007, the Regulations Number 47 year 2012, which specifically are implemented based on Qanun (another term of regulation of Acehnese Government) of Aceh West Government Number 10 year 2015. The CSR program is conducted based on local wisdom of community of West Aceh. Research Limitations/Implication-CSR is the obligation of corporate however the realization and the governmental role sometimes are unconformity, therefore the alternative model of CSR is needed to be formed particularly for corporates which are located in Aceh West District. Orignality/Value-In addition to increasing the theoretical understanding of CSR, this paper can be of relevance to corporate liability and community rights.
The case of excavation of excavated land C which occurred in Muara Satu Subdistrict, Lhokseumawe City, excavation activities of C excavated soil in the Padang Sakti Mountains and Paloh Punti Muara Satu Lhokseumawe areas without a permit, became increasingly uncontrollable by the excavation owner and the excavation entrepreneur. Dredging activities in the area are of great concern to a number of people because they can cause environmental damage.The purpose of this study is to identify and explain civil liability in extracting C minerals, civil liability barriers in extracting C minerals, and efforts to resolve civil liability barriers in extracting C minerals in Lhokseumawe City. This type of research is an empirical juridical research, namely an integrative and conceptual method of analysis to identify, process and analyze documents to understand the meaning, significance, and relevance that produces descriptive data in the form of written or spoken words from people or observed behavior. The results showed that the form of Civil Accountability in extracting C minerals in Muara Satu Subdistrict, Lhokseumawe City, such as the responsibility of the perpetrator to the victim of excavating C excavation material due to illegal actions, pollution and / or environmental destruction, loss of other people or the environment, and accountability. activities to pay compensation and / or take certain actions. Obstacles to civil accountability in excavating C excavation materials in Muara Satu Kota Lhokseumawe include internal barriers including lack of knowledge of legal responsibility, lack of concern for environmental damage, and lack of coordination between the authorities. Then external factors due to economic limitations, factors of limited education, lack of legal awareness in the community and lack of coordination between parties. Efforts to resolve internal Civil Accountability Barriers include negotiating with the community, improving coordination with all related parties, and conducting mediation. Then efforts to resolve external obstacles include coordination with all related parties, regularly supervising mining activities without permits, coordinating between parties and Deliberations and conducting community legal outreach. It is recommended that law enforcement against the excavation of illegal land C excavation should be maximized and it is necessary to arrest the perpetrators of illegal land extraction and not only take preventive measures.
Legal protection for consumers who use cosmetics sold through social media based on Article 2 of Law No. 8 of 1999 on Consumer Protection states that, consumer protection is held as a joint venture based on five relavan principles while paying attention to the efficacy and usefulness for the parties who must perform the rights and obligations that have been determined. Along with the development of technology offerings through social media selling goods to consumers through the internet network, one of them is cosmetic products. In Article 9 of Law No. 11 of 2008 concerning Information and Electronic Transactions states that every business person must provide clear information related to the products offered. This study aims to find out and explain about legal protection for consumers against the purchase of cosmetic products through social media as well as legal consequences for businesses that have harmed consumers in the purchase of cosmetic products through social media. This research method uses normative juridical research method with statutory approach. The nature of this thesis research is descriptive research using primary legal data in the form of Law No. 8 of 1999 on Consumer Protection and Law No. 11 of 2008 on Information and Electronic Transactions, as well as secondary and tertiary legal data. Based on the results of the study that legal protection for consumers against the purchase of cosmetic products through social media has not been fully fulfilled and protected in accordance with consumer protection laws. This is due to the lack of awareness of businesses towards the fulfillment of consumer rights and obligations in transactions through social media. Thus the legal consequences for businesses that have harmed consumers must pay compensation to consumers. It is expected that businesses should pay proper attention to the rights and obligations of businesses in offering cosmetic products through social media which is basically stipulated in the provisions of consumer protection laws and consumers must also be wiser and careful in buying cosmetic product offerings offered by businesses on social media so that no unwanted things happen to consumers.
Prinsip tanggung jawab sosial dan lingkungan perusahaan diatur dalam Pasal 74 Undang-Undang Nomor 40 Tahun 2007 Tentang Perseroan Terbatas. Berdasarkan ketentuan tersebut perusahaan berkewajiban untuk melaksanakan CSR, namun dalam kenyataannya masih ada beberapa perusahaan yang mengabaikan dan belum sepenuhnya melaksanakan CSR. Salah satunya PT. Perkebunan Nusantara II Kebun Kwala Sawit yang belum dapat melaksanakan CSR secara benar, hal ini akan menimbulkan dampak negatif terhadap lingkungan yang dikhawatirkan akan mencemari lingkungan serta menghambat aktivitas masyarakat di kemudian hari. Berdasarkan hasil penelitian pelaksanaan tanggung jawab perusahaan terhadap lingkungan dilakukan dengan cara pengolaan kembali terhadap limbah dan pemantauan setiap satu bulan sekali serta melakukan kunjungan sosialisasi kepada masyarakat yang bertujuan agar hubungan masyarakat dengan perusahaan tetap terjalin dengan baik, hambatan dalam pelaksanaan tanggung jawab sosial perusahaan yaitu adanya kecemburuan di kalangan masyarakat terhadap penduduk yang diterima sebagai tenaga kerja di perusahaan, adapun upaya yang dilakukan oleh pihak perusahaan yaitu dengan pemanfaatan kembali limbah yang dihasilkan serta memberikan bantuan berupa beasiswa, pembangunan sekolah, dan pemberian bahan pangan berupa beras.
Penelitian ini bertujuan untuk mengetahui Peran Polisi terhadap penanggulangan tindak pidana Pencurian dengan kekerasan. Dengan mengkaji Undang-Undang Nomor 2 Tahun 2002 tentang Kepolisian Republik Indonesia dapat mengetahui tugas dan fungsi sehingga polisi berperan seperti apa, bila terjadi tindak pidana pencurian dengan kekerasan, hambatan-hambatan dalam penanggulangan tindak pidana pencurian dengan kekerasan, serta upaya dalam menanggulangi hambatan-hambatan dalam rangka penanggulangan tindak pidana pencurian dengan kekerasan di wilayah Kepolisian Resor Aceh Timur. Metode penelitian pada penelitian ini adalah penelitian hukum Yuridis Empiris dan Yuridis Normatif. Sumber data adalah data primer dan data sekunder, pengumpulan data dilakukan dengan penelitian lapangan dan dokumentasi. Berdasarkan hasil penelitian diperoleh, bahwa peran Polri dalam penegakan hukum terhadap pelaku pencurian dengan kekerasan masih rendah, banyaknya kasus pencurian dengan kekerasan yang terjadi di wilayah Kepolisian Polres Aceh Timur yang tidak terselesaikan. Peran Polres Aceh Timur hanya mencakup cara preventif yaitu cara mencegah terjadinya pencurian, cara represif yaitu menindak tegas terhadap pelaku kejahatan. Hambatan Polres Aceh Timur dalam menanggulangi Tindak Pidana pencurian dengan kekerasan meliputi kurangnya kesadaran masyarakat untuk menjadi saksi dalam sebuah kasus, lambatnya informasi, tidak ditemukannya barang bukti, dan kurangnya personel dalam Kepolisian.
