Th is article deals with the right to inclusive education. Article 24 of the UN Convention on the Rights of Persons with Disabilities (CRPD) provides not only that children with disabilities should not be discriminated against but also that they should be able to participate in the general education system. Children with disabilities should therefore be educated in mainstream schools. Th e article begins by studying the right to education in international human rights law (Section 2). It continues with a general introduction to the CRPD (Section 3). Aft er discussing its draft ing history, the article goes on to analyse Article 24 of the CRPD, examining the concept of inclusive education, the duty to provide reasonable accommodation and the obligation to adopt support measures and asking the question whether special schools should still be available (Section 3).
<p><em>Persons with disabilities are vulnerable group and would be found anywhere in any situation. They become refugees since their conditions of persecution and they should leave out from their country. Unfortunately, the problem occured when persons with mental disabilities could not indicate their well-founded fear as stated in the 1951 Convention on the Status of Refugees. Regarding the problem, Convention on the Rights of Persons with Disabilities (CRPD) may be the answer to settle the problem since CRPD is the human rights approach to disability and recognizes the right of persons with disabilities to equality in most aspects of life. From CRPD, refugees with disabilities can show a well-founded fear thus giving a hope for them in obtaining refugee status and gaining access equivalent to refugees in general. UNHCR uses the CRPD as a reference in carrying out the responsibilities and commitments for the rights of refugees with disabilities.</em></p>
Duta besar merupakan kepala perwakilan diplomatik yang dilindungi secara internasional. Untuk memperlancar misi yang akan ia jalani, maka perwakilan diplomatik tersebut diberi hak kekebalan dan hak keistimewaan. Penembakan terhadap duta besar Italia yang terjadi di Republik Demokratik kongo tahun 2021 merupakan kasus yang menjadikan permasalahan bagaimana upaya negara penerima dalam melindungi pejabat diplomatik, serta upaya negara pengirim dalam meminta pertanggungjawaban kasus tersebut. Penelitian ini adalah penelitian hukum normatif yang dikumpulkan berdasarkan studi kepustakaan dianalisis secara kualitatif dengan metode deduktif dan dengan pengumpulan data sekunder. Dari hasil analisis, berdasarkan Konvensi Wina 1961 dan Draf Pertanggungjawaban Negara ILC 2001, RDK dianggap telah gagal dalam menjalankan kewajibannya melindungi serta menjamin keamanan terhadap keselamatan duta besar Italia. Seharusnya RDK dapat melakukan tindakan lebih daripada hanya melakukan pertanggungjawaban secara satisfaction. Oleh karena itu, didapat kesimpulan bahwa Italia berhak meminta pertanggungjawaban secara internasional atas kelalaian RDK melindungi pejabat diplomatik.
Asylum and Law for International Refugee. Some criteria have been determined for individual to have refugee status, and the country which grant the asylum would give the status based on social and humanity considerations. Therefore, the issue of granting asylum and refugee status can be seen not only political perspectives but also from juridical perspectives since it has been governed by international law, specifically the law of International Refugee. This article would focus on some cases on how asylum seekers got their refugee status, especially on the case of some Papuans who have obtained their refugee status and temporary visa from the Australian government in 2006.
