Early age marriages have become widely reported through various media both print and electronic media, because early marriage is one of the causes of divorce in Indonesia. Divorce due to early marriage raises social problems in the community, such as high dropout rates for students, poverty, crime. The emergence of early marriage is caused by the low awareness of adolescents to understand Law number 1 of 1974 concerning marriage. This study discusses the understanding of law number 1 of 1974 concerning marriages which plays a role for adolescents to postpone early marriage in Indonesia. This research method uses a quantitative approach, involving 213 adolescent subjects with an age range of 17-22 years. Retrieval of data using a questionnaire that is the attitude of understanding marriage law, life satisfaction, resilience, and delaying early marriage. Analysis of research data using Spearman RHO correlation and non-linear regression. The results showed that the attitude of understanding marital law plays a role in delaying early marriage in adolescents in Indonesia.
Sengketa konsumen merupakan salah satu hal yang perlu diresponi secara pro-aktif mengingat perkembangan bidang perindustrian dan perdagangan secara nasional maupun dalam skopa kawasan ASEAN. Mediasi merupakan salah satu alternatif penyelesaian sengketa baik secara out of court maupun sebagai bagian dalam penyelesaian perkara di pengadilan dalam menyelesaikan sengketa konsumen. Penyelesaian sengketa melalui BPSK merupakan salah satu penyelesaian sengketa di luar pengadilan dengan menggunakan mediasi sebagai salah satu alternatif penyelesaian sengketanya. Efektifitas ini dilihat berdasarkan terbentuknya Akta Perdamaian dari kedua belah pihak yang bersengketa. Jika Akta Perdamaian terbentuk, maka hal tersebut dapat dijadikan tolok ukur efektifnya mediasi. Hukum acara yang berlaku baik Pasal 130 HIR maupun Pasal 154 Rbg, mendorong para pihak untuk menempuh proses perdamaian yang dapat diintensifkan dengan cara mengintegrasikan proses ini ke dalam peradilan. Oleh karena itu, posisi mediasi sebagai bagian dari Hukum Acara Perdata sejatinya dapat memperkuat dan mengoptimalkan fungsi lembaga peradilan dalam penyelesaian sengketa. Penelitian ini dilakukan dengan menggunakan metode pendekatan normatif-empiris dengan spesifikasi deskriptif-analitis dalam menelaah mengenai efektifitas mediasi dalam sengketa konsumen oleh Badan Penyelesaian Sengketa Konsumen (BPSK) di DKI Jakarta. Pengolahan dan analisis data dalam penelitian ini dilakukan dengan metode analisis normatif-kualitatif.
In 2014–2017, there were two tests of the same norms in the Marriage Law, namely the Constitutional Court Decision Number 74 / PUU-XII / 2014 and 22 / PUU-XV / 2017. However, there is a difference in the verdict between one judgment and the next. In Constitutional Court Decision Number 22/PUU-XV/2017, the Constitutional Court changed the previous stance that stated that the age limit norm was constitutional, changing it to unconstitutional, which led to the follow-up of the lawmakers to revise the Marriage Law. This study will compare judges' considerations in the decisions of Constitutional Court Number 74 / PUU-XII / 2014 and Number 22 / PUU-XV / 2017. It will be sought against the Constitutional Court's background changing its stance from one ruling to the next. This research uses normative research methods with a conceptual and philosophical approach to legislation. The results showed that the difference underlying the two rulings was in the excavation of legal sources by judges in their legal considerations.
Mediation as one of Alternative Dispute Resolution having the ascendcy in the Indonesian Legal System. This mediation was considered as a way of dispute resolution humane because the mechanism for decision making within the authority of the parties in dispute and maintaining good relation and fair because the parties conveyed his intention and first each other and negotiated a way to the problem and the result obtained the agreement of the parties. According to article 130 of Herzien Inlandsch Reglement and article 154 Rechtreglement voor de Buitengewesten mediation has known at Indonesian court. After that in 2008 the Indonesian Supreme Court with The Supreme Court Regulation (PERMA) No.1 in 2008 introduced a regulation requiring that all court should adopt a uniform mediation procedure. At 2016 Indonesian Supreme of Court make a revision in that regulation with The Supreme Court Regulation No. 1 in 2016. Therefore, the author interest to inspect how effectiveness the mediation with PERMA No.1 in 2016 in reducing made divorce in religion court. This reseach used research law normative by adopting qualitative. The data used is secondary data by the use of primary and secondary as a basic source and analysis of data was qulitative. Processing by the use of deductive method. Religion Court in Denpasar was chosen because moslem presentase in the Bali Province especially in Denpasar is lower betweetn Hindu presentase. And then the presentase divorce case in religion court in Denpasar increasing every year. This research focus on the implementation of mediation in divorce after The Supreme Court Regulation No. 1 in 2016 and to finding the supporting and inhibitor factor on the mediation
