Registration of land title evidences an indefeasible ownership. However, many people have become victims of fraud. Due to the increase in fraud and the weaknesses of the registration system in the country, this study aims to provide solution to the problem. The paper highlights the controversy surrounding indefeasibility and the concept of federalism in the land administration systems in Malaysia. The electronic land systems and fraud prevention measures in the country are also analysed. While other jurisdictions have title assurance fund, it is not available in Malaysia. Thus, this paper suggests the tightening of the security measures to prevent fraud.
Freedom of information (FOI) refers to the right given to the public to seek information from government bodies. In Malaysia, to date, there is no federal legislation on the right to information. The system of official secrecy under the Official Secrets Act 1972 is the default system of information access. This paper aims to discuss the current constitutional setup, information disclosure system in Malaysia and the cost-benefit analysis of enacting the Freedom of Information Act at the Federal level. This article uses content analysis methods of previous literature, courts’ judgements, and statutory interpretation. This article also studies the international paradigm of FOI in various human rights instruments. This article concludes that the arguments favouring enacting the FOI law outweigh the contentions against such regulation.
This paper examines the behaviour of vendors and purchasers indirectly through the judicial decisions in Malaysia, Australia, and the United States. The decided cases illustrate that buyers are still indolent in their duty to conduct pre-purchase inspections, some vendors were seen to have actively concealed defects in the property and fraudulently misrepresented the conditions of the properties. This paper suggests consumer education for both the vendors and purchasers and the extension of the jurisdiction of either the Tribunal for Homebuyers Claims or the Tribunal for Consumer Claims to include matters regarding the dispute as to the condition of the property.
