The relevance of the study is based on the development of scientific and technological progress and the expansion of the labor market, including in the framework of international cooperation. Moreover, the introduction of quarantine due to the spread of Covid-19 has led to increased attention to remote work. The aim of the study is to analyze the legal aspects of remote work in accordance with the labor legislation of Ukraine and the European Union, focusing on the concept of remote work, the rights and obligations of remote workers. In our study, we determined that in the European Union, the key points in relation to the rights granted to teleworkers, which the countries parties to the agreement have undertaken to incorporate into their national legislation and collective agreements, are data protection; the voluntary nature of telecommuting; equipment; organization of working time; privacy. The originality of the study is based on more effective ways to improve labor productivity in Ukraine, labor discipline, compliance with labor guarantees for remote work. It is necessary to revise and legislatively regulate the key principles of compliance by employees with labor discipline, providing the employee with proper working conditions, supporting the employer in search of new opportunities to provide employees with work, improving the technical aspects of ensuring the relationship between business and government, responsibility for results and the labor process.
The purpose of the article is to identify and evaluate the main measures of migration policy and legal regulation in the field of combating the effects of the economic crisis, effective ways to regulate the situation on the labor market and employment and measures to address the economic crisis in the country of destination and origin. Methods of analysis and synthesis, theoretical generalization, historical, scientific-analytical, systematization and classification were used to identify scientific and theoretical bases of labor migration. The practical significance of the obtained results lies in the possibility of using the results of the study to overcome the socio-economic consequences of the coronary crisis by countries; to improve the activities of migration services.
The research proves that the breach of stability in the economic system, as well as the appearance of the instability phenomenon, arise immediately after losing some balance between the population and government. As the result, the development of the institute of the state with the proper regulative set of instruments, as well as the extending of the international relations can take the instability from micro-and mezo-levels to macro-and meta-levels. It analyses and defines the concepts: state and budget instability. Particularly, the definition of the political, financial, social, as well as economic instabilities is enhanced. Key problems of state instability, which may occur as a result of unsuccessful government regulation and ineffective management with budgetary funds, are distinguished. The aim of the article is to develop the concept of instability and its types, to determine the causal interconnection for distinguishing the problems of state instability that may influence the state economic development. The target of the research is the theoretical and methodological bases of the instability occurrence and its state regulation. The research methodology. According to the aim set, we determined the methodological basis of the research: the abstract-logical method-to sum up the theoretical basis of instability; the systemic analysis-to characterize the types of instability; the analysis and synthesis-to estimate the influence of the state instability on the state economic development; the graphics method-to demonstrate final results of the research; economic-statistic-to define the problems of the state instability that may influence the state economic development. Conclusions. It has been proved that instability is the condition of the system that is characterized by the variation that happened through breaking the existing interconnection in it. The instability is that basic feature that characterizes all social and economic processes. The danger occurs when the level of instability in the state exceeds some standards. We determined political, economic, social, financial and budget instabilities as well as gave the authors' definition of these phenomena after distinguishing the theoretical bases of instability. It has been proved that the government instability consists of these types. We have proposed to determine the government instability as the condition of the state characterized by the constant changes in political, economic, social, financial, and budget spheres because of the factors that influence changes in its structure and functional characteristics accompanied by the phenomena that have a negative influence on the state development in general. The indexes analysis of the international rating and collation of its results with the graphic interpretation of the government instability have helped to prove that Ukraine has the low level of the government instability. The article discusses some aspects of the process of termination of the employment contract with the head of the enterprise, institution or organization at the request of the elected body of primary trade union organization (trade union representative). It is noted that the requirement to terminate the employment contract with the director does not terminate employment contract by itself, but obliges the employer to terminate it. Carried out the analysis of the distinctive features of the consideration of the proposal of the trade union body regarding the termination of the employment contract with the head of the legal entity on the Draft Labor Code. The innovations of the bill are recognized as justified, timely, such that they correspond to the modern level of development of labor relations and called upon to balance the interests of the parties to the employment contract. A number of features that need improvement have been identified, namely: 1) consolidation of the obligation to consider the representation of the trade union for its validity; 2) the need to assess the severity of violations of labor legislation, collective agreements and contracts, the Law of Ukraine "On Trade Unions, their Rights and Guarantees"; 3) Elimination of the obligation of the employer to appeal against the requirement of the primary trade union organization (trade union representative) as a condition for stopping the execution. The author of the article notes that the determination of the nature of the violation by the head of the enterprise, institution, organization of labor legislation will contribute to the effectiveness of sanctioning legal norms, and the abolition of the obligation of the employer to appeal the requirement of the primary trade union organization (trade union representative) to the court will make it possible to prevent abuse of their rights by the trade unions.
In the current conditions of the economic development in Ukraine, an important place is occupied by the system of insurance relations. Although the insurance market in Ukraine is characterized by a low level of insurance culture, some insurers don’t fulfill their obligations, distrust of the population towards insurance companies, imperfection of state regulation mechanisms of the activity of these enterprises, low incomes of the population, etc.The research of the domestic insurance market shows that insurance itself provides the population with insurance protection against various insurance risks and is the most stable source of long-term investments. The existing insurance system in Ukraine is based mainly on principles that have demonstrated its inefficiency and do not meet the needs of the national economy. Urgency of this problem requires further study of the history of the insurance development as a whole, the identification of the development stages of insurance of the independent Ukraine and identification of a group of factors that influence the insurance market development.Growth of the entrepreneurial activity in the late nineteenth century and a stormy development of joint-stock companies were the beginning of agreements conclusion, definition of the rules of insurance, expansion of the reinsurance activity.Developmentoftheinsurancebusinesshasshownitsprofitability, therefore, in our country there is no significant decline in the number of insurance companies. In the competitive environment, insurance companies are increasingly expanding their range of insurance risks, seeking to increase their competitiveness. Insurance has a long history of formation, and research into historical aspects of the insurance development has begun with its evolution. Having analyzed literary sources, we have come to the conclusion that in Ukraine, the insurance development took place under the legal conditions that existed in the period of Kievan Rus and Tsarist Russia, and later in the USSR. Only the adoption of the Law on Insurance in 1996 made the domestic insurance market more developed and modern. Current state and four groups of factors that influence the insurance market development in Ukraine are analyzed. Prospects for the development of the insurance market in Ukraine are substantiated.
