This paper specifically examines the concept of law in a sociological study to find out how the law develops and how the law implemented or enforced as a unity in the legal system. This paper-based on the normative juridical method, using legal materials collected and analyzed using qualitative methods. The results show that the sociological of law studies as part of the activities of drafting legal products and the preparation of legal products is not just a juridical process. The processes of transformation from social desires into laws and regulations both in political and sociological contexts do not only occur during the formation of a regulation, continue and continually correct the legal products that produced. Law enforcement related to the sociology of law that observes the reality of how the law is working on different social structures, this scientific approach is expected to not only provide advice related to the development of legal science alone, but also must be applied, but unfortunately in the development of this science itself is not able to develop dynamically because observations that are not equally displayed in providing input to the development of legal protection in Indonesia.

Tujuan dari Penelitian ini mengkaji pengaturan hukum mengenai harta bersama yang belum dibagi akibat adanya perceraian yang dijadikan objek jaminan kredit dan untuk memberikan kepastian hukum mengenai kedudukan bank sebagai kreditor yang memberikan kredit dengan jaminan harta bersama yang dijadikan sebagai objek jaminan. Metode yang digunakan dalam penelitian ini adalah metode penelitian hukum normatif. Hasil dari studi menunjukkan bahwa (1) Diperlukannya persetujuan dari salah satu pihak apabila ingin menggunakan harta bersama, hal tersebut sesuai dengan ketentuan Pasal 36 ayat (1) Undang-Undang Perkawinan. (2) Pemberian kredit oleh Pihak Bank dilaksanakan dengan prinsip kehati-hatian, dan berdasarkan prinsip 5C agar tidak terjadinya produk perjanjian kredit yang cacat hukum dan dapat dibatalkan demi hukum. Akibat hukum dari pembebanan jaminan atas harta bersama yang diperoleh selama melangsungkan perkawinan dengan tanpa adanya persetujuan dari salah satu pihak atas kredit adalah dapat dibatalkannya (voidable/ vermetig) perjanjian jaminan tersebut.

The different interest between employer and employee is potentially causing Industrial Dispute between them. Industrial Disputes is dominated by Termination of Employment (laid off) dispute; one of the reasons is company efficiency. Based on that matter, it needs to be studied regarding its legality, procedure, employees’ rights and the pattern of Industrial Dispute Settlement regarding laid off through company efficiency. Based on these problems, several conclusions can be drawn. Firstly, Termination of Employment must be based on a valid reason under the law. Secondly, Termination of Employment due to company’s efficiency can only be done on the condition that the company permanently closed. Thirdly, in the case of termination of employment for company efficiency, the company must pay attention to the employee’s rights in the form of compensation based on consideration of wages and the employee’s duration of work. Fourthly, the pattern of Industrial Dispute Resolution that can be adopted by the parties is bipartite, tripartite and Industrial Relation Court.

Berupaya untuk mengkaji serta mengetahui pengaturan terkait pembuangan limbah pabrik ke laut sebelum adanya izin yang diterbitkan oleh Pemerintah Daerah serta mengetahui dalam tindakan pengawasan pemerintah Kabupaten Jembrana terhadap Pabrik yang membuang limbah ke laut sebelum adanya izin dari Pemerintah Daerah. Penelitian ini mengaplikasikan penelitian hukum normatif. Izin tidak berkenan melaksanakan entitas melainkan diizinkan. Maka, kegiatan kepada suatu sasaran tertentu dalam latar belakangnya tidak diperbolehkan. Seseorang maupun organ aturan - aturan bisa melaksanakan usaha maupun aktivitas atas suatu objek tersebut bila memperoleh izin dari pemerintah/pemerintah daerah yang menumbuhkan fungsinya kepada aktivitas yang dilaksanakan oleh orang atau golongan yang berhubungan. Peranan pemantauan terkait halnya kepada izin yang sudah dimunculkan secara absolut dibutuhkan bertujuan menghindari kekeliruan – kekeliruan terkait dengan izin yang sudah dimunculkan sehingga tidak disalahgunakan. Pemantauan terkait dengan izin tersebut merupakan tanggungjawab instansi - instansi yang mengeluarkan izin tersebut. Abstrak: Penelitian ini bertujuan untuk mengetahui prinsip mengenal nasabah pada perdagangan berjangka dalam aturan hukum di Indonesia dan untuk mengetahui pelaksanaan prinsip mengenal nasabah pada perusahaan pialang berjangka di Bali.
