The development of democracy in Indonesia is running very rapidly after the 1945 amendment. One of the developments within the frame of politics characterized by constitutional formula that provides a basic framework state that sovereignty belongs to the people and carried out in accordance with the Constitution. On the basis of the formulation of the succession of leadership in the executive and legislative branches are directly implemented as the mandate of Article 22 E of paragraph ( 2). However, in practice the constitutional arrangements in the Law Number 42 Year 2008 concerning General Pemlihan President and Vice President shows inconsistent with the statement in the constitution . As set out in Article 3 paragraph ( 5 ) states that the election of President and Vice- President held after an election DPR, DPD and DPRD. At the end of the Constitutional Court through Decision No. 14/PUU-XI/2013 stated that the selection of models is unconstitutional. <p>Indeks Persepi Korupsi (IPK) Indonesia pada tahun 2013 menggambarkan posisi Indonesia berada pada skala eskalasi poin yang belum bergeser secara signifikan. Kondisi tersebut mengharuskan adanya komitmen dari Pemerintah dan segenap komponen masyarakat untuk secara berkelanjutan melakukan upaya-upaya yang masif dan sistematis dalam menjalankan agenda pemberantasan korupsi di Indonesia. Dengan menggunakan metode yuridis normatif tulisan ini akan membedah apa yang menjadi dasar urgensi rekonstruksi politik hukum pemberantasan korupsi, serta bagaimanakah model rekonstruksi politik hukum dalam pemberantasan korupsi tersebut. Hasil penelitian menunjukkan bahwa salah satu upaya masif dan sistematis dimaksud dapat dilakukan melalui gagasan rekonstruksi politik hukum pemberantasan korupsi melalui strategi penguatan penyidik dan penuntut umum independen Komisi Pemberantasan Korupsi. Gagasan ini dimaksudkan sebagai sarana untuk mendorong arah politik kebijakan dan regulasi agar menopang kinerja KPK secara optimal dalam bidang pencegahan dan/atau penindakan korupsi dalam skala pusat sampai daerah. Rekonstruksi politik hukum diarahkan pada argumentasi baik dalam ranah substansi hukum, struktur hukum, kultur hukum, dan sarana- prasarana melalui penguatan sumber daya manusia baik dari sisi kualitas, kuantitas maupun anggaran. Oleh karenanya dukungan sektor politik diperlukan agar strategi pemberantasan korupsi inheren dengan gagasan yang termaktub di dalam Konvensi Perserikatan Bangsa-Bangsa Menentang Korupsi (United Nations Convention Against Corruption , UNCAC)</p><p>Indonesia’s corruption perception index (CPI) in 2013 illustrates Indonesia position in escalation stage point has not improved significantly. These conditions requires commitments from the Government and all society components to make massive and systematic efforts continuously in carrying out eradication of corruption agenda in Indonesia. Using juridis normative method this article will discuss urgents points of reconstruction of corruption eradication legal policy, also how the model of reconstruction of corruption eradication legal policy its self. This research results shows that one massive and systematic efforts can be done through reconstruction idea of ecorruption eradication legal political strategy through strengthening independent investigator and prosecutor of the Corruption Eradication Commission. This idea intends to encourage political direction of policy and regulation in order to support optimal performance of the Commission in the field of prevention and/or execution of corruption both in central and region scale. Political legal reconstruction directs to the substance of the argument in legal substance, legal structure, legal culture, and infrastructure through the empowerment of human resources from quality, quantity and budget aspects. Therefore political sector strategy supports needed in order to eradicate corruption inherent with the idea that inline within United Nations Convention against Corruption, UNCAC (United Nations Convention Against Corruption).</p>
<p>Amanat Pasal 33 ayat (3) Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 menyebutkan bahwa, “Bumi dan air dan kekayaan alam yang terkandung di dalamnya dikuasai oleh negara dan dipergunakan untuk sebesar besar kemakmuran rakyat”. Namun demikian dalam ranah praktek penyelenggaraan negara maka pengelolaan Sumber Daya Air di Indonesia mengalami pergeseran paradigma pasca ditetapkannya Undang-Undang Nomor 7 Tahun 2004 tentang Sumber Daya Air yang cenderung mengarah pada praktek privatisasi sehingga sering memicu terjadinya konflik sosial. Untuk mengkaji permasalahan yang ada, maka dalam penulisan karya ilmiah ini menggunakan metode Socio Legal . Dapat disimpulkan bahwa pergeseran paradigma penguasaan sumber daya air oleh swasta dan/atau pihak asing yang bersifat monopoli dan eksploitatif memiliki potensi untuk menimbulkan konflik sosial. Untuk itu diperlukan revisi terhadap ketentuan Undang- Undang Nomor 7 Tahun 2004 tentang Sumber Daya Air guna mewujudkan kedaulatan atas Sumber Daya Air dan melakukan harmonisasi dan sinkronisasi hukum terhadap aturan pelaksanaan dari Undang-Undang tersebut. Pemerintah juga perlu melakukan identifikasi guna mengeluarkan kebijakan agar sumber daya air dimasukkan dalam kategori bidang usaha yang tertutup dari penanaman modal.</p><p>Mandate of Article 33 paragraph (3) of the Constitution of the Republic of Indonesia Year 1945 states that, “The earth and water and natural resources contained therein shall be controlled by the state and used for maximizing peopleprosperity”. However, in the realm of the state governing, practice management of water resources in Indonesia experienced a paradigm shift after the enactment of Law Number 7 year 2004 regarding Water Resources which intended to lead of privatization practices that potentially lead to social conflict. The constitutional court through the Constitutional Court Decision No. 85/ PUU-XII/2013 opened a new chapter in the management of Water Resources Indonesia directed at political reconstruction prismatic design rights law Mastering State Upper Water Resources based on the values of social justice and popular participation in order to ensure the realization of the people’s sovereignty on Water Resources. The final goal of this study was expected tobridge formation of paradigmatic legal framework for the management of water resources in order to reach future welfare.</p>
The freedom to express ideas and participate in the government is often manifested through democratic voting or involvement in general elections, but the processes taking place in elections cannot fully ensure that the members of the public can get their rights to the freedom of speech and participation in the government. With doctrinal legal method, this research has found that there seems to be an urgency to initiate an online petition platform in Indonesia as an alternative channel accessible to all the members of the public in order to optimize the exercise of the freedom of speech and equal participation in the government. Online petition systems have been around in Indonesia for quite some time, initiated and managed by change.org as a private organization along with other non-governmental organizations, but the legal loophole regarding online petitions that represent public participation in forming policies has not been capable of guaranteeing the attention or responses from the government over particular issues. In order to gain more perspectives, this article compare the online petition systems in the US and South Korea that were initiated by presidential agencies, and also the online petition in Germany that is under the direct management of the Petition Committee bellow the parliament (Bundestag). Therefore, it is concluded that Indonesian president has the power to rule the government in order to respond the urgency to give protection and fulfill Human Rights, especially freedom of speech and the rights to participate in the government by setting the legal basis.
Terwujudnya tata kelola pemerintahan yang baik dan bersih di daerah merupakan bagian dari cita-cita otonomi daerah. Oleh karena itu, gagasan untuk membentuk KPK di daerah merupakan komitmen dalam rangka menindaklanjuti ketentuan Pasal 19 ayat (2) Undang-Undang Nomor 30 Tahun 2002 tentang Komisi Pemberantasan Tindak Pidana Korupsi. Ide membentuk KPK di daerah tiada lain dimaksudkan sebagai upaya simultan untuk mempercepat strategi pencegahan, edukasi, dan pemberantasan tindak pidana korupsi yang selama ini telah menjerat Kepala Daerah, Pejabat Daerah dan Pengusaha baik ditingkat Provinsi, Kabupaten/Kota. Dalam konteks pembentukan kelembagaan KPK di daerah bukan dimaksudkan untuk mengambil alih tugas pemberantasan korupsi dari lembagalembaga yang ada sebelumnya baik ditingkat Kepolisian dan Kejaksaan.
