Generally, people with disability has the same right to other people. However, in the reality of social living, it is often found they are treated discriminatively. Therefore, law number 13 Year 2003, law number 8 Year 2016, and law number 4 Year 1997 are created accordingly toward regional regulation Number 2 Year 2008 as the policy of Surakarta government in protecting them. This study has purpose to find out and analyze the implementation of Law Number 2 Year 2008, to analyze the implementation of right protection of labors with disability, and to understand and analyze the hindrance in its implementation. The study is done through empirical juridical approach using analytic descriptive. The study results some findings. First, the right of labors with disability has been regulated by Article 45 until 54 of Law of People with Disability Number 08 Year 2016. Second, Article 53 in the Law also states that Regional Government, State-owned Enterprises, Regional-owned Entprise are obliged to employ at least 2%. Beside that, private enterprises is also obliged to employ labors with disability at least 1% from the whole labor’s numbers. Third, based on the supervision of the implementation of Regional Regulation Number 2. Year 2008, about administration sanction from the mayor toward any company breaking the reuirements, are not yet realized.
Land acquisition for public purposes is an activity intended for the public interest that uses community land. To be able to carry out development in the public interest, the government uses state land. If state land is not sufficient or cannot maximize development, the government can use land from individuals or groups by carrying out the land acquisition. In implementing land acquisition, the land acquisition team must pay attention to the rights of the people affected by land acquisition. Irregularities that often occur in the implementation of land acquisition are related to discrimination, intimidation, and violence. These rights are included in human rights, which must be upheld and protected because this is closely related to property rights. Human rights give an understanding that the right to own something is the right of every citizen, including the right to own land is one of the human rights inherent in each person per person in groups. While property rights must not be taken arbitrarily and against the law, such matters are regulated in Article 28H of the 1945 Constitution. This paper concludes that the construction activities of the New Yogyakarta International Airport (NYIA) carried out violated human rights; this is because the land acquisition team has committed violence, discrimination, and violence against the people affected by land acquisition. The form of legal protection provided by the government is proper compensation.
Anak merupakan sumberdaya manusia bagi pembangunan dan penentu suatu bangsa. Berkaitan dengan pemenuhan ruang untuk mendukung minat dan bakat anak ke hal yang lebih positif dan bisa menambah ruang kreatifitas bagi anak tentunya pemerintah juga perlu mendukung tidak hanya berasal dari orang tua saja. Karena dengan adanya dukungan dari seluruh pihak maka minat dan bakat anak bisa berkembang dengan baik didukung dengan berbagai saranan dan prasarana baik yang disediakan oleh orang tua, sekolah, dan pemerintah daerah setempat. Adapun peran yang dapat diberikan oleh pemerintah daerah setempat adalah dengan memberikan ruang bagi seluruh masyarakat diberbagai kalangan, salah satunya ruang terbuka hijau berupa alun-alun, sarana olah raga dan tempat bermain bagi anak yang ramah terhadap anak. Alasan pemerintah daerah memiliki peran dalam pemenuhanhak anak melalui ruang terbuka hijau ini tercantum dalam Undang-undang No. 26 Tahun 2007 tentang Penataan Ruang. Bahwa setidaknya pemerintah bisa memberikan sedikitnya 20% dari luasan wilayahnya untuk pemenuhan ruang terbuka hijau yang bisa digunakan oleh masyarakat dalam beraktivitas secara positif misalnya, di alun-alun kota. Penelitian ni menggunakan metode penelitian legal studies dimana mengungkap masalah yang ada di amasyarakat dengan kemudian memberikan solusi. Pada dasarnya dalam setiap upaya yang telah dilakukan oleh pemerintah telah mengarah pada pemenuhan hak ruang terbuka hijau baik public mapun privat baik berupa regulasi maupun program-program yang pro terhadap kepentingan anak. Namun masih ada beberapa hal yang menjadi kendala dalam melaksanakan program karena masih belum maksimalnya partisipasi dari seluruh stakeholder terutama untuk kondisi di Kabupaten Jember, sedangkan untuk di Kabupaten Banyuwangi secara keseluruhan bisa dikategorikan sebagai pemerintah kabupaten yang secara partifsipatif dalam hal pemenuhan ruang terbuk ahijau bagi anak, karena hampir rata di setiap program yang dilaksanakan selalu melibatkan peran dari seluruh stakeholder terkait.
