The article considers a new, digital aspect of ensuring environmental safety. Information about the environment, natural resources, their protection and use, management processes in the sphere of interaction between society and nature, and public access to such information remain important factors in building a civilized environmental state policy. The development of innovative technologies leads to the advancement of rational use of natural resources and environmental protection. The ways of transmitting information, including environmental, to citizens are being improved and supplemented. The article reflects the issues of digitalization of environmental safety, as well as formulates recommendations for the further development of environmental safety in digital format.
The legal regime of environmentally unfavourable territories is studied in the article. Nowadays, more and more areas of the territory of Kazakhstan are exposed to unfavourable impact on the environment due to the increasing influence of developing scientific and technical progress. These activities do not only harm environmental systems and individual natural resources but also complicate and sometimes make it impossible for citizens to live in these areas. Such areas of the territory need to be restored, the damage should be compensated, and the inconveniences of human habitation should be compensated. Thus, there is a need to establish special legal regimes governing the respective responsibilities of those who carry out activities that degrade the environmental situation in these areas, the authorities, and the rights of citizens living in these areas. The objective of the presented study is to analyze the legislation regulating the legal regime of environmentally unfavourable territories in the Republic of Kazakhstan and the international experience of such regulations. As a result of the research, the authors conclude that it is necessary to develop a comprehensive legal regulation to address most of the issues of ensuring the restoration of environmentally unfavourable areas, compensation for environmental damage, and reimbursement to the population.
It is currently impossible to imagine the improvement of some sphere without modern technologies. The president of Kazakhstan, Nursultan Nazarbayev in the Presidential Message to the people underlines the need in the wide introduction of the elements of the Fourth Industrial Revolution. The objective of the paper is to analyze the retrospective review of the information technologies in the Criminal Code of Kazakhstan. As the method studying the research subject, we use the analysis of the criminal procedure legislation, digital programs, as well as the opinion of the scientists and specialists regarding the possibility of the introduction and use of the information technologies in the activities of the judicial authorities. A series of scientists prefer new progressive technologies in the criminal court processing, including the electronic criminal case. Besides, the programs dedicated to the development of the court system in Kazakhstan contain a series of prerequisites forcing the court reform to introduce the electronic base of the criminal case.
The urgency of the problem stated in the article is due to the fact that the development of entrepreneurial initiative of citizens directly depends on a number of factors, including protection from illegal acts, actions (inactions) of officials, government bodies and organizations. Therefore, the main purpose of the article is to develop the theoretical foundations of a uniform approach to the formation of a model for organizing the activities of law enforcement agencies to ensure the protection of the rights of entrepreneurs. The leading method for the study of this problem is the method of analysis, which contributed to the consideration of this problem from the inside, by isolating and studying certain parts of law enforcement agencies as an independent form of ensuring the protection of the rights of entrepreneurs. It was also used comparative legal and regulatory methods. The level of trust of entrepreneurs is a direct reflection of the interaction of law enforcement agencies, state bodies and organizations in the field of ensuring the protection of the rights of entrepreneurs, which depends on various aspects, including: legislative support, professionalism of officials, law enforcement practice. The results of the study can be used in modern conditions as a basis for improving the practice of law enforcement in ensuring the protection of the rights of entrepreneurs, in the educational process, as well as in conducting further research on the analyzed field.
This paper focuses on the problem of providing legal groundwork for the balance of traditional and alternative energy development in the context of the Republic of Kazakhstan’s shift to green energy. As it turns out, there is no comprehensive strategy for providing legal groundwork for the use of energy, both traditional and renewable. Today there are two major standpoints among both scientists and experts on the ground: for and against the renewable sources. Thus, the main task of lawyers is to develop an approach that makes both sides agree on the issue. The paper performs an analysis of Kazakhstan’s legislation on energy development, energy preservation and the use of renewable energy sources, identifying its shortcomings and gaps. The attained results provide a basis for recommendations to create a legal regulatory framework for the development of traditional and alternative energy in the Republic of Kazakhstan, as well as to improve environmental legislation in terms of environmental protection during construction, location and use of traditional and alternative energy facilities.
