Due to the unlawful practice of pyramid scheme business, there has been noticeable damage on communal value and living law within the affected communities. This condition becomes the source of dispute and affects the loss of trust, harmony and the damage of social and communal order. The segregated litigation process, which is the most common solution; could not solve the complex nature of the dispute. Therefore, there should be a new comprehensive alternative to restore both financial loss and the damage within the affected communities. The research aims to study the use of communal and socio-cultural value in the settlement of Pyramid scheme dispute, which is not only vulnerable as the modus of the scam but also as the solution for the victims. The method used is juridical empiric with juridical normative approach. The research shows the analysis of legal framework to solve the conflict within the community caused by pyramid scheme progressively. The research indicates that penal mediation could be the solution of the problem. The research outcomes could contribute to the alternative to settle the dispute, also to restore the social order and to restore the loss accordingly.
The people's economy is one of the principle instruments of Indonesian economic democracy. To overcome economic conditions during the Covid-19 pandemic, people are motivated to overcome problems to meet their needs for life independently. Communities and digital-based small and medium enterprises have unwittingly formed a mutually beneficial relationship between business transactions. The concept of populist economy is re-actualized in their economic activities. This study aims to examine the reconstruction of the populist economic model as the development of small and medium-sized businesses based on digital transformation in a post-covid-19 pandemic. This research is a literature study with descriptive-analytic research specifications. The results of the study show that the concept of a populist economy and digital transformation in small businesses is a model for strengthening the populist economy during the COVID-19 pandemic, but it has not yet been measured regarding the sustainability of the model's reconstruction after the pandemic. This concept can become a new paradigm in order to strengthen the national economy after the COVID-19 pandemic.
Skema Piramida secara tegas dilarang oleh Undang-Undang Nomor 7 Tahun 2014 tentang Perdagangan dalam Pasal 9, namun praktiknya skema bisnis ini terus berkembang. Masyarakat sering dikelabui oleh penawaran yang menggiurkan. Penawaran tersebut sering dikemas dalam bentuk penipuan dan penyalahgunaan keadaan (undue influence). Kelemahan KUH Perdata sebagai payung hukum yang mengawal proses kesepakatan berinvestasi disinyalir menjadi faktor penyebab pemberi penawaran melakukan strategi pemasaran skema piramida ini, sekalipun Undang-Undang telah jelas melarang. Hanya Pasal 1321 KUH Perdata yang dapat dijadikan sandaran hukum terhadap penyalahgunaan keadaan (undue influence), sementara aspek hukum yang timbul dari praktik investasi bisnis skema piramida ini begitu kompleks. Penelitian ini memfokuskan kajian terhadap bentuk penyalahgunan keadaan (undue influence) dan pelanggaran prinsip utmost goodfaith yang dilakukan oleh pemberi penawaran (Offeror) terhadap penerima penawaran (offeree) dalam praktik investasi bisnis skema piramida, sekaligus mengkaji aspek hukum yang timbul dari penyalahgunaan keadaan, dan mengkaji tanggung jawab hukum offeror dalam praktik investasi bisnis skema piramida. Dengan menggunakan metode pendekatan yuridis-empiris dan spesifikasi penelitian bersifat deskriptif analitis, kemudian dianalisis secara yuridis kualitatif, hasil penelitian menunjukan bahwa, dalam praktik skema piramida berbagai bentuk penyalagunan keadaan (undue influence) terhadap offeree, antara lain karena keadaan ekonomi, keadaan psikologis, dan memanfaatkan nilai hukum yang hidup (living law), seperti nilai komunal dan gotong royong, serta faktor kepercayaan (trust). Awalnya sederhana dari penyalahgunaan keadaan ketika proses penawaran, namun proses berkesinambungan menjadi sebuah kontrak investasi bisnis yang sarat dengan beberapa pelanggaran dan menimbulkan multi aspek hukum, yang meliputi aspek hukum perdata, aspek hukum pidana, dan aspek hukum ekonomi. Oleh karena itu, penyelesaian kasus hukum yang berdimensi multi aspek hukum ini hanya dapat dilakukan dengan pendekatan tanggung jawab yang multi aspek hukum, yaitu model konvergensi tangungjawab hukum. Even though the Covid-19 outbreak caused anxiety, it must be interpreted as having brought positive things to economic life. One of them is the emergence of Micro, Small and Medium Enterprises (UKKM) whose business activities are facilitated by information technology. The business relationships that have been built are characterized by family values, mutual cooperation values, and efforts to deal with the epidemic period, as well as being forward-looking after the outbreak ends. This social phenomenon is to actualize the people's economy in digital economic transactions. This study assumes a people's economy paradigm based on mutualism and the principle of kinship in digital economic transactions. The paradigm of economic development based on the values of local wisdom and Indonesianness is a new hope for the people's economy in realizing the constitutional mandate that prioritizes the interests of the people. The role of technology in the economy during the Covid-19 era is very large, having an impact on efficiency and effectiveness in meeting the economic needs of the community. Based on this, it is necessary to conduct a legal study of the actualization of the people's economy based on mutualism and the principle of kinship as an economic recovery post-covid-19. The purpose of the research is to examine the legal basis for the People's Economy on community economic activities based on the post-covid-19 digital economy. The research method uses secondary data, in the form of legal documents on laws and regulations in the economic field, various research results from legal and economic experts and field data in the form of interviews and observations. The data were analyzed qualitatively juridically, through legal interpretation, harmonization and synchronization of laws. The results of the study show that, the concept of a populist economy is actualized in community economic transactions based on post-covid-19 digital economic technology; Mutualism and familial values can be used as a legal basis in the paradigm of constitutional national economic development.
