The purpose of the article was to identify and reveal the main contemporary modern legislative initiatives aimed at ensuring the expression of will by means of information technology. The main methodological tools applied in the study were comparative legal analysis and observational method. The study showed that effective manifestation of will requires further implementation of state-of-the-art systems of electronic petitions, digital resources and electronic voting. Relevant legislative initiatives should serve to increase the capacity for citizen participation and discussion. It is substantiated that the priority directions of changes in legal systems should be: 1) reforms aimed at closing the digital divide in access to information technologies; 2) technical improvement of the electronic voting procedure; 3) increasing the relevant informatization of citizens; 4) ensuring maximum protection of the state digital environment. Special attention should be paid to the legal development of a comprehensive technocratic approach. It is concluded that it is desirable to apply hybrid technology for the people to realize their right to vote and give them more opportunities to participate in the processes of governance and digital governance.
The leading idea of the article is the application of the most appropriate methodology for disclosing the essence and content of law, its origin, evolution, contradictions and their coordination in the context of the relationship between natural and positive law, social and individual paradigms, in particular, in the context of nationalizing the individual, and, on the contrary, individualizing the collective in a wide humanistic plane. This aspect synthesizes approaches to the disclosure of individual and collective through the categories of �self�, where dialectical, phenomenological, existential and other approaches are qualified as communicative and dialogic paradigm, which today finds its practical embodiment in lawmaking and law enforcement. Feeling the controversy of these views, the authors emphasize the deepening of the humanistic content of the legal regulator of social relations. Domestic modern legal science in its development should focus on deepening the humanistic content of the normative regulation of social relations. This actualizes the need to solve such scientific problems as the methodology of research and functioning of law, achieving a harmonious relationship between individual and collective in law, the connection of its natural and positive aspects, etc. A fundamentally new definition of the essence of law is proposed, not as the will of a certain class or majority, but as the will to self-existence, which is expressed in the phenomenon of self as a harmonious synthesis of individual and social. In this context, to investigate the legal phenomena dialectics can be effectively used not as a materialistic or idealistic methodology, but as the most general theory and way of ascending to the truth. After all, opposites in law are not necessarily antipodes, but can act as interacting components of legal reality
The article examines modern debatable approaches to the understanding of regulatory defining concepts of information law, its objectivity and methodological certainty. Along with the existing points of view, the author argues the necessity and importance of the qualification of information relations as a subject of information law, which determines its specificity as a social phenomenon, separating it from the system of other legal relations. In the process of analyzing the techniques and methods used in information law, the author focuses on such a unique regulatory method as “intention”, which, in his opinion, should be the key method of information and legal realities. It is “intention”, according to the author, that possesses the mechanism of transformation of information by consciousness into appropriate, necessary, purposeful and suitable for practical use. This new idea is proposed for further discussion and possible constitution in information law.
The article deals with the peculiarities of the formation and functioning of information consciousness in Russian society, which today is largely focused on militant, aggressive actions against Ukraine and other Western countries. The subject line of the article is the analysis of objective circumstances and subjective factors that take place in the conscious complex of Russian citizens. The main attention is paid to the conditions of formation of these factors and their action. It is concluded that this war could have been avoided if Russia had not artificially created an aggressive atmosphere towards Ukraine.
The proposed article provides a critical analysis of approaches to understanding civil-military relations not only as a control factor, but also a broader social phenomenon. It was found that the latter serves as a kind of social integrative factor in the field of security and defense of Ukraine. The problem is covered through the prism of dialectical categories of content and form, essence and manifestations, general and separate, unity and difference of civil and military relations, etc. The author does not limit himself to stating the existing achievements in the formation of these relations, but raises the question of their further fruitful development in the legal system of Ukraine.
