The aim of the article is to analyze the concepts of bullying and mobbing, to determine their social and legal nature, to formulate our own definition of these terms. The subject of the study is an analysis of the concepts of bullying and mobbing. The research methodology includes the following methods: system and structural method, formal and dogmatic method, historical method, clustering method, comparative and legal method, legal modeling method and others. The results of the study. The definition of bullying is comprehensively studied, its types are singled out, the phases of its development are determined. Practical implication. The difference between bullying and mobbing, as well as between bullying and conflict, is studied. Value / originality. Based on the research conducted the authors’ concepts of bulling and mobbing are proposed.
The legal basis for the national security of Ukraine is the Constitution of Ukraine, according to which laws, doctrines, concepts, strategies, and programs are developed, which determine the targets and guidelines for the national security policy of the Ukrainian state in order to timely identify, prevent, and neutralize real and potential threats to the national interests of Ukraine. Ukraine is one of the countries with a deficit of its own natural hydrocarbon resources. Lack of necessary reserves, dependence on energy imports pose a threat to the country's energy security. The transformation of the oil and gas sector of Ukraine and the creation of an effective organizational model should provide sufficient control over the areas of activity to ensure effective resource consumption in the oil and gas sector of the economy, grouped into appropriate blocks. Blocks should include directions of action to achieve the effect and further development of the industry, as well as to ensure effective control. Conclusions on the development of the oil and gas sector in Ukraine are made, ways to improve using the SWOT analysis technique are suggested. That is, the author has analyzed the oil and gas sector from the point of view of existing and potential opportunities, threats, advantages, and disadvantages. At the same time, the requirements of the Third Energy Package for the separation of the transport function from the gas production and supply business are provided, and it is also taken into account that the operator is removed from the structure of a vertically integrated company and is not associated with it by legal, financial, and managerial ties. The success of modernization should become an important driver of reform of the entire state oil and gas sector of the Ukrainian economy and have a long-term impact on the entire society, the lives of citizens, and business.
The aim: The study of international and domestic practices of Ukraine concerning the legal regulation of liability for exerting illegal influence on the results of official sports competitions within the context of such means of its commission as the use of doping for the purpose of obtaining additional arguments to emphasize the benefit / the inexpedience of criminalization of such acts as quasi-corruption fraudulent activities. Materials and methods: The article implements doctrinal provisions of domestic and foreign scientific developments in relation to the liability for illegal influence on the results of official sports competitions by means of the use of doping as well as national and foreign criminal legislation, established law enforcement practices, and results of the sociological survey. For such purpose, the authors utilized the methods of analysis and synthesis, a comparative legal method, methods of survey and generalization of viewpoints, research findings. Conclusions: Authors have established the absence of necessity for the introduction of the criminal prohibition in respect of athletes for the use of doping for an entire span of their professional career as well as for the use of doping as the means for exerting illegal influence on the results of official sports competitions. The expedience of further studies has been ascertained by drawing from the experience of the EU, Australia, Canada, USA, and other countries concerning the legal regulation of liability for exerting illegal influence on the results of official sports competitions, legal consequences of the use of doping and corresponding law enforcement practices within the context of grounds and principles of criminalization of socially dangerous acts elaborated by the criminal law studies.
The relevance of the analysis of Sustainable Development Goals is based on the 2030 Agenda for Sustainable Development. The purpose of the study is to create a model of management/regulation of the quality of education and scientific research systems based on Sustainable Development Goals. The data of the ratings that reflect certain tasks of the Sustainable Development Goals, including those related to educational and scientific activities, are analyzed. The methodology of calculating the index of the success of realization of separate purposes of sustainable development is used. Bibliometric analysis as a research tool is used to create a quality of education management model. The example of the roadmap for achieving SDGs within the relationship chain “quality of education and science + partnership and networks–innovation–socio-economic impact–sustainable development goals” is provided. The suggested methodology for determining the index of success in achieving Sustainable Development Goals includes managing education systems, implementing scientific research, and managing/regulating the economy on micro-(university), meso-(regional), and macro-(national) levels. The tool in this case is a strategy for achieving KPIs, which can be fundamentally implemented in the form of a roadmap, with detailing of its elements using other tools. The “management/regulation” stage of the process of achieving Sustainable Development Goals is concretized by a mind map.
