The development of P2P lending fintech in Indonesia is expected to be a solution for people who have not been influenced by conventional banking services. However, the growth of illegal P2P lending fintech creates new legal problems that risk the public who use these financial institution services. The purpose of this research is to explore the concept of legal certainty as an effort to provide legal protection for customers of P2P lending fintech in Indonesia. This research uses normative legal research method and the theory used to analyse the data is legal certainty theory. This research uses a statute and conceptual approach. The result of this research reveals that the regulations related to the industrial licensing of P2P lending fintech have shown legal certainty. This case is manifested through good and clear norms in statutory regulation. However, in its implementation, particularly ones that related to law enforcement of P2P lending fintech executant, it has not been implemented consistently. By this reason, there is no legal certainty for illegal P2P lending fintech actors. Therefore, to achieve legal certainty, law enforcement that is consistent, consequent, and not influenced by subjective circumstances is necessary. With consistent law enforcement, it is expected that legal protection for P2P lending fintech customers can be manifested. Keywords: Statutory regulation; fintech; bank services
A financial institution that provides technology-based money lending services or financial technology peer to peer lending (fintech P2P lending) is expected to be a solution for people in Indonesia who are unable to access conventional banking services. However, in line with the developments, there are also a presence of legal problems relating to the growing number of illegal fintech P2P lending companies which are harmful to the people who use these financial institutions. This article is the result of research related to the legal protection of Fintech P2P Lending customers in Indonesia. This study applied the normative legal research method with the theory of legal protection as the analysis theory. The approaches used were the statute approach and the conceptual approach. The result of the study showed that legal protection for fintech P2P lending customers has been sufficiently regulated, but the regulation is still partial and spread out in various laws and regulations. In the future, comprehensive regulations related to the legal protection of fintech P2P lending customers are urgently needed.
Kejahatan atau tindak pidana oleh korporasi terhadap pekerja dimungkinkan terjadi mengingat semakin meningkatnya persaingan usaha ditengah menyempitnya lapangan kerja. oleh karenanya penelitian ini dibuat dalam bentuk paper bertujuan untuk mengetahui bentuk tindak pidana oleh korporasi terhadap pekerja dan cara penyelesaiannya. Untuk menjawab permasalahan tersebut, penelitian ini dilakukan dengan cara studi kepustakaan hukum positif terkait ketenagakerjaan melalui logika berpikir deduktif-induktif dan hasil pengamatan yang dilakukan oleh peneliti. Hasil penelitian menunjukkan bahwa bentuk tindak pidana oleh korporasi dikategorikan berupa tindak pidana kejahatan dan pelanggaran sedangkan penyelesaiannya belum dapat menjerat korporasi secara langsung karena tindak pidana oleh korporasi terhadap pekerja merupakan delik aduan yang berpotensi mengakibatkan kerugian yang lebih besar bagi korban tindak pidana, selain itu profesionalitas dan kompetensi penegak hukum dibidang ketenagakerjaan tidak berimbang dengan tingkat kompleksitas tindak pidana serta inkonsistensi peraturan perundang- undangang mengakibatkan sulit terwujudnya penegakan hukum tindak pidana oleh korporasi terhadap pekerja sehingga dibutuhkan terobosan hukum atau cara yang dapat memulihkan hubungan diantara keduanya baik pelaku maupun korban.
