Bipartite negotiations are an effort to resolve disputes that the parties must take in advance, as mandated in Article 3 of Law Number 2 of 2004. Suppose there is an agreement in bipartite negotiations. In that case, these agreements are written into a collective contract that is then registered with an industrial relations court to obtain a registration certificate. However, collective agreements that have been agreed upon and registered and have executorial legal force are still being sued by one of the court parties. The purpose of this study is to obtain an overview and analyze the concept of procedural law regarding the implementation of collective agreements with legal certainty in terminating employment in Indonesia. This research is legal research using a statutory approach, a conceptual approach, and a case approach—the collection of material through the literature study method, with primary and secondary legal materials. Furthermore, the traditional fabric is studied and analyzed by the approaches used in this study to answer legal issues in this study. In this article, the author offers 2 (two) procedural law concepts regarding the implementation of collective agreements. First, a lawsuit for disputes that have been resolved through a cooperative agreement may not be accepted by the court, and the judge does not need to process the case further. Still, a file research process is sufficient to explore the main problem of the parties, if the problem is related to one of the parties breaking the promise by referring to the recorded evidence issued by the same court, the Panel of Judges is sufficient to hold a deliberation and only determine with a single judge that the case has been resolved and choose the order for execution. The second concept is that the lawsuit is still being processed. Still, it is only continued until the interim decision stage if, at the initial examination stage, it is known that the dispute has been resolved through a collective agreement. This is far more effective, efficient and fair, and provides legal certainty for the parties.
This research discusses the problems of: first, the implementation of the Government Regulation No 11 of 2010 on the Control and Utilization of Deserted Land in Tasikmalaya Regencykendala dalam memetakan tanah yang terindikasi terlantar karena pada faktanya identifikasi dan penelitian tidak dilakukan dengan melibatkan instansi yang kewenangannya terkait dengan penetapan tanah terlantar. Kedua, pendayagunaan tanah terlantar belum diarahkan untuk menambah dan mengoptimalkan penyediaan lahan pertanian sehingga penertiban tanah terlantar tidak memberikan nilai tambah, atau memperkuat ketahanan pangan di Propinsi Jawa Barat.
The ASEAN Economic Community (AEC) currently requires diverse economic agreements and laws across the region because it moves in a robust multilateral connection based on political, industry, welfares, services, and especially migrant workers. Indonesia, as the largest provider of migrant workers, should have been prepared to deal with the cases of migrant workers. There is a need to build up consensus and appropriate Indonesian labor laws, such as the establishment of multi-partite bodies for purposes of recognition in the ASEAN Economic Community. Thus, this paper attempts to analyze the current existing labor laws in Indonesia. External desk research was employed in this study as the methodology. The results found that the several laws do not meet the needs of the Protection of Indonesian Migrant Workers concerning the Placement and Protection of Indonesian Workers Abroad. There has not yet provided proportional tasks and authority between the Central Government, Regional Governments, and the private sector. The implementation of the Protection of Indonesian Migrant Workers requires strict supervision and law enforcement. The supervision including protection before work, during work, and after work, and law enforcement should accommodate the administrative sanctions and criminal sanctions.
K ebutuhan terhadap perumahan telah mengalami peningkatan, sebagaimana yang terjadi pada masyarakat dunia, terutama pada masyarakat perkotaan, dimana populasi penduduknya sangat besar, sehingga memaksa pemerintah untuk berupaya memenuhi kebutuhan akan perumahan di tengah berbagai kendala seperti keterbatasan lahan perumahan. Adapun permasalahan yang akan dikaji dalam penelitian ini yaitu implikasi perubahan peruntukan prasarana dan sarana terhadap pemilik rumah yang mengalami kerugian di kawasan permukiman dan arah pengaturan peruntukan prasarana dan sarana di kawasan permukiman dalam mewujudkan lingkungan yang teratur, serasi dan berkelanjutan. Penelitian ini menggunakan metode pendekatan yuridis normatif melalui penelitian kepustakaan yang menitikberatkan terhadap data sekunder yang difokuskan untuk mengkaji kaidah atau norma-norma dalam hukum positif. Analisis data yang dipergunakan adalah yuridis kualitatif yakni memberikan gambaran secara khusus berdasarkan data yang dikumpulkan. Hasil penelitian menunjukan bahwa implikasi perubahan peruntukan prasarana dan sarana terhadap pemilik rumah yang mengalami kerugian di kawasan permukiman yaitu terjadi eksklusifitas dalam pemanfaatan fasilitas tersebut, karena fasilitas sosial dan fasilitas umum merupakan public goods yang pemanfaatannya tidak dipungut biaya dan tidak boleh ada pihak yang dikecualikan dalam pemanfaatan fasilitas tersebut. Pemilik rumah dapat mengajukan tuntutan kepada pengembang perumahan untuk mendapatkan kompensasi akibat dari kerugian yang dialaminya. Arah pengaturan peruntukan prasarana dan sarana di kawasan permukiman dalam mewujudkan lingkungan yang teratur, serasi dan berkelanjutan adalah untuk mengawasi, mengendalikan dan memanfaatkan ruang, lahan serta sumber daya alam yang tersedia dalam pelaksanaan pembangunan perumahan di kawasan permukiman, sehingga dapat menciptakan keteraturan dan keterpaduan antara lahan yang akan dibangun dengan persentase yang telah diatur.
