Modern business trends create new requirements for the use of innovative tools for searching and generating ideas in order to increase the efficiency of enterprises. It is creativity that contributes to the personal and professional self-development and self-improvement of the company’s employees. Analyzing the research of recent years in the field of management, it can be emphasized that in order to achieve important organizational results, such as innovation, growth and management success, it is creativity that is important. Key industries in the creative economy include: advertising, architecture, arts and crafts, design, fashion, film, video, photography, music, performing arts, publishing, research and development, software, computer games, electronic publishing, television and radio. The era of informational and intellectual development became the era of the XXI century, which was marked by the transition from rationality to creativity. The concept of the “creative class” offers a new way of understanding the mechanisms of wealth creation. In the period of the “post-industrial” economy, the new driving forces of economic development are the “super creative core” (including artists, designers) and “creative professionals” (including managers, lawyers). Organizational management is complex and multidimensional in nature. It combines a number of elements, activities and processes aimed at achieving the organization’s goals. Amidst a rapidly changing business landscape, organizations are moving forward from the classic criteria of cost and performance to integrating creativity and innovation for overall efficiency. Such integration involves the study and implementation of concepts at different functional levels of management for the development of the creative potential of enterprises. Development of creative solutions at the enterprise involves market research and analysis, generation of new ideas, evaluation of alternatives and implementation of innovative solutions. Creative management is what is needed in the 21st century in order for the business to stay afloat and maintain its competitive advantage. The main skill that managers are looking for in skilled workers today is creativity. Creativity management ensures the development of an individual's creative skills, his ability to generate fundamentally new ideas and bring them to a concrete result. That is why the achievement of the goals and objectives of creative management requires improvement of the tools for the development and implementation of innovative solutions.
As of today, the principle of zero-waste production is not only a global trend, but also an effective mechanism for protecting and preserving the environment, as well as making fuller use of the resource potential of enterprises. The main idea of zero-waste manufacturing is the transformation of raw materials received by the enterprise, its residues, as well as waste obtained in the production process, into finished products that can generate income. In this regard, modern companies are making the transition from a linear to a circular economy in order to preserve the ecosystems of our planet. This transition is characterized by waste-free production as well as maximum use of raw materials and production capacity. Such an important step will not only save our planet and ultimately ourselves, but will also bring in the profits that companies simply lose by destroying waste. Ukraine lags far behind European countries in the field of waste management, and the volume of waste generated, the state of landfills and dumps indicate extreme risks to the environment and the population. Inefficient waste management in Ukraine is, in particular, a consequence of the existing linear economic model. Thus, the issue of developing zero-waste technologies and effective implementation of zero-waste manufacturing at Ukrainian enterprises, in particular with the involvement of European experience, becomes extremely important. Accordingly, the article analyzes the essence, key principles and principles of zero-waste manufacturing in the domestic and European areas in order to adopt the best experience of the EU, which is currently a leader in this aspect in the world. The key aspects, principles and features of zero-waste manufacturing were analyzed, as well as successful European and domestic practices of its application were demonstrated. These findings will be useful for individual domestic enterprises, industries, the country and civil society as a whole.
The growth of the acceptability of emotional intelligence as a major factor in the assessment of personality and effective human resource management is substantiated. Emotional intelligence as the ability to develop potential, empathize, cooperate, motivate and develop others cannot be separated from the system of effective activity and human resource management. The human personality is crucial in determining organizational leadership and success in terms of challenges and opportunities, as well as the passage of both international and bilateral relations. The main areas of emotional intelligence are: identifying emotions, using emotions, understanding emotions and managing emotions.The key components of emotional intelligence in the workplace are: self- awareness – the ability to understand one’s emotions, when making decisions, being aware of weaknesses and strengths, determining one’s goals and life values; self-regulation – the ability to manage emotions without succumbing to impulses; motivation – the ability to achieve one’s personal goals for increasing productivity – for the fact of achievement; empathy – the ability to understand the emotions of others, empathize with them and, despite this, make objective decisions; social skills – the ability to build strong relationships with your team. Nowadays there are no clear metrics for evaluating EQ yet, but there is a set of personality characteristics that helps determine the approximate level of the emotional indicator. The growing complexity of the business world requires great self-confidence, honesty, communication, conflict management and diversity to keep a global enterprise on the path to productivity and sustainability. It is emphasized that when managing a company, the relationship between employees and managers should have a mutual understanding of each other’s emotions, what they feel or think, what views on various topics they have, what strengths or weaknesses they possess, how they react, approach to work that motivates them and so on. It is emphasized that the understanding of the truth of emotional intelligence is still being studied in various fields, because its perception is individual.
The paper investigates the problems of protecting intellectual property rights when goods crossing the customs border of Ukraine. The necessity of reforming the national system for the protection of intellectual property rights and bringing it into line with international legislation has been proved. The proposed projects of changes in domestic legislation, contributing to the implementation of the EU mechanisms for the protection of intellectual property rights at customs, and will allow to strengthen the fight against counterfeit and pirated products during their movement across the customs border of Ukraine are considered. Analyzed the main normative legal acts on the research problem, and developed a methodology for customs control and customs clearance of goods containing intellectual property. The paper describes the most common violations in the field of intellectual property rights, among the main authors highlighted the problems of parallel import and patent trolling. It is noted that an important step towards the protection of intellectual property rights was the creation of an appropriate customs register of objects of intellectual property rights as part of the Unified Automated System of the State Customs Service. The specified system includes the established procedure for online registration of the corresponding objects of intellectual property rights, which makes it possible to reduce the time for consideration of applications and their placement. It is indicated that the protection of intellectual property rights provides for an increase in the level of prevention and counteraction to the movement across the customs border of Ukraine of goods that violate such rights, and helps to cleanse the domestic market from counterfeit products. Today, a new Customs Register of Intellectual Property Objects is being formed and a center for operational expertise is being created.
The essence and features of the customs regime «customs warehouse» in modern conditions of foreign economic activity are investigated. The sequence of stages of customs clearance of goods in the customs regime «customs warehouse» is clarified. The problems of «customs warehouses» and the peculiarities of placing goods in the customs warehouse, as well as the peculiarities of storage of goods, the permissible terms of their storage and the list of necessary documentation are analyzed. Today, the «customs warehouse» regime in the process of implementing various foreign economic transactions is extremely relevant and profitable. «Customs warehouse» is a customs regime according to which foreign or Ukrainian goods are stored under customs control with conditional full exemption from taxation by customs duties and without the application of measures of non-tariff regulation of foreign economic activity. This customs regime is applied when placing goods at the customs warehouse. Operations carried out with goods stored in the customs regime of the customs warehouse at the customs warehouse should not change the characteristics according to which these goods were classified according to the Ukrainian classification of goods of foreign economic activity. The term of storage of goods in the customs regime of the customs warehouse may not exceed 1095 days from the date of placement of these goods in the specified customs regime. Taking in to account the above, the «customs warehouse» mode is extremely convenient to use, and it can also be used when the final buyer is still unknown when importing goods, but when using this customs regime, the following problems arise: 1. Imperfection of the existing legislative regulation of activities when placing goods in the customs regime «customs warehouse». 2. Lack of clearly established tariffs for the use of services for the placement of goods in a customs warehouse. It is necessary to establish a unified pricing policy for the provision of customs warehousing services, taking into account the regional aspect. 3. Insufficient system of control and accounting of balances of goods in the customs warehouse. Such leftovers of goods can be in the customs warehouse for an unlimited time, and foreign economic entities will spend money on their storage. In addition, there is no legal regulation that could regulate the control of residues. 4. Inconsistency of the equipment of customs warehouses with existing requirements, since the customs warehouse must be provided in a favorable state, namely: technical and protective means to ensure the necessary regime, for the allocation of separate areas for customs warehouses near checkpoints or customs posts. 5. Failure to comply with the storage conditions of products, as well as the occurrence of financial losses of both counterparties under a foreign trade contract. The storage of goods in customs warehouses should be organized in such a way as to exclude the risks of damage to property, its theft, and destruction. According to the individual specialization of the product, there are requirements for the formation of special storage conditions, namely the appropriate temperature regime, which must always be maintained. In some cases, the only well-thought-out solution to solve this problem is to place the product in a temporary storage warehouse. To simplify customs procedures, the customs authorities of Ukraine are actively implementing the mechanism of electronic declaration, which significantly reduces the cost and reduces the time of customs clearance and enhances the effectiveness of customs control. Issues of efficiency of customs clearance are extremely important in foreign economic activity, as they directly affect the volume of exports and imports.
