Clinical Ethics in the Context of Language and Cognitive Impairment: Rights and Protections

Abstract: Ethical dilemmas are particularly complex when a patient has a communication disorder. Questionable decision-making capacity can affect an individual's ability to participate in the informed consent process. When other cognitive impairments as well as language deficits are present, the risk of losing one's right to autonomy is greatly increased. Alternatively, the protection afforded those who are clearly incompetent may be limited if a person appears to have decision-making capacity but is unable to adequatel… Show more

“…While discussions around autonomy and cognitive impairment are popular in bioethical research (see e.g. [ 105 , 106 ], privacy, on the other hand, has recently gained more attention for both researchers and designers [ 107 ]. The relation in the reviewed studies between cognitive impairment and privacy seemed to be reversely correlated –intrusions into the privacy of older persons with cognitive impairments were deemed as more justified [ 35 , 53 ], which necessarily does not mean that its ethical, but a practical fact that such intrusions become possible or necessary in the given context.…”

“…SLTs are under-recognised by other members of multidisciplinary team (McCormick et al, 2017). Brady-Wagner (2003) recommends that SLTs should be involved in raising awareness of their role in DMC assessments, as well as be involved in training supportive communication techniques to increase the reliability of DMC assessments. Results of the current study indicate that participants' confidence in training other members of multidisciplinary team increased significantly from pre-training level of 1.92 to post-training level of 4.49.…”
