This legal paper digs into the legal perspective of deepfake and makes recommendations to the EU institution to regulate the phenomenon, as deeply entrenched with technology-facilitated gender-based violence. First, it looks into the risk involving the creation of deepfakes for purposes such as social media manipulation, reputation damage, and sexual abuse. Second, it will describe the factual circumstances around the current European law and to what extent the AI technology generating deepfake content is regulated. Lastly, the paper will contain a comparative analysis of legislation between European law and US legislation, with the purpose of understanding how current regulations are moving, producing recommendations to the EU institutions, especially in the framework of the AI Act.
