Der Sammelband “Parental Care and the Best Interests of the Child in Muslim Countries” ist die erste Veröffentlichung, die eine rechtsvergleichende und länderübergreifende Analyse zum Sorgerecht in den islamischen Ländern bietet. Herausgegeben wird der Sammelband von Priv.-Doz. Dr. Nadjma Yassari, Leiterin der Forschungsgruppe „Das Recht Gottes im Wandel: Rechtsvergleichung im Familien- und Erbrecht islamischer Länder“ am Max-Planck-Institut für ausländisches und internationales Privatrecht, Dr. Lena-Maria Möller, Wissenschaftliche Referentin der Forschungsgruppe, und Dr. Imen Gallala-Arndt vom Max-Planck-Institut für ethnologische Forschung. Die Publikation fasst die Ergebnisse eines Workshops zum Kindschaftsrecht zusammen, den die Forschungsgruppe gemeinsam mit Rechts- und Islamwissenschaftlern im April 2015 in Rabat/Marokko abgehalten hat. Am Beispiel von zehn islamischen Ländern – von Indonesien bis Marokko – wird die Entstehung und Entwicklung des Grundsatzes des Kindeswohls analysiert und der Frage nachgegangen, ob und inwieweit sich internationale Konventionen über das Recht des Kindes auf die Entwicklungen des Sorgerechts in islamischen Ländern ausgewirkt haben. Insbesondere werden die geltenden Rechtsnormen, sowohl materiell als auch verfahrensrechtlich, untersucht. Zudem wird der Rechtspraxis sowie der Rolle der Justiz besondere Aufmerksamkeit geschenkt. Neben den Länderberichten umfasst der Band zwei rechtsvergleichende Analysen zu Fragen des Sorgerechts im Völkerrecht und internationalen Privatrecht. Mit seinen aktuellen Untersuchungen zum Sorgerecht in islamischen Ländern, die weit über eine reine Untersuchung der Gesetzeslage hinausgehen, hat der Sammelband eine hohe praktische Relevanz für alle Rechtspraktiker, die im Bereich grenzüberschreitender Sorgerechtsstreitigkeiten tätig sind.The book “Parental Care and the Best Interests of the Child in Muslim Countries” is the first publication to provide a comparative and cross-national analysis of parental care regimes in Islamic countries. The book is edited by Priv.-Doz. Dr. Nadjma Yassari, director of the research group “Changes in God’s Law: An Inner-Islamic Comparison of Family and Succession Laws” at the Max Planck Institute for Comparative and International Private Law, together with Dr. Lena-Maria Möller, a senior research fellow in the same research group, and Dr. Imen Gallala-Arndt of the Max Planck Institute for Social Anthropology. It compiles the results of a workshop on parental care held by the research group together with legal and Islamic studies scholars in Rabat, Morocco in April 2015. Drawing on the example of ten Islamic countries – from Indonesia to Morocco – the volume analyses the emergence and evolution of the notion of the best interests of the child and investigates the question of whether and to what extent international conventions on the rights of the child have impacted the development of parental care regimes in Islamic countries.
