Indonesia ratified the Minamata Convention in Kumamoto Japan through Law No. 11 of 2017 concerning the Minamata agreement. This ratification is intended to provide protection for the environment from the use of mercury-based materials. Previous studies showed that the use of mercury in Artisanal and Small-Scale Gold Mining (ASGM) had a significant negative impact on health and the environment. The problem is whether the problems that need to be done in the application of the above regulations and maintaining environmental sustainability? The research method was carried out through related discussions and discussions with 25 relevant stakeholders, from miners, and local community, which was selected purposively. The research result was analysed qualitatively. This type of research is a combination of normative juridical and empirical juridical. For normative juridical law materials are used regarding relevant laws and regulations and cases. Data analysis was carried out descriptively. The result of the study indicate that The Minamata Convention has not been implemented as expected. The research recommended the need for policies to formalize ASGM in Gorontalo as a solution to facilitate access to mercury use. The need to educate miners about the dangers of using mercury, need alternative solutions to technology interventions for miners.

Since the world economy has been confronted with an increasing risk of supply shortages of critical raw materials (CRMs), there has been a major interest in identifying alternative secondary sources of CRMs. Bauxite residues from alumina production are available at a multi‐million tonnes scale worldwide. So far, attempts have been made to find alternative re‐use applications for bauxite residues, for instance in cement / pig iron production. However, bauxite residues also constitute an untapped secondary source of CRMs. Depending on their geological origin and processing protocol, bauxite residues can contain considerable amounts of valuable elements. The obvious primary consideration for CRM recovery from such residues is the economic value of the materials contained. However, there are further benefits from re‐use of bauxite residues in general, and from CRM recovery in particular. These go beyond monetary values (e.g. reduced investment / operational costs resulting from savings in disposal). For instance, benefits for the environment and health can be achieved by abatement of tailing storage as well as by reduction of emissions from conventional primary mining. Whereas certain tools (e.g. life‐cycle analysis) can be used to quantify the latter, other benefits (in particular sustained social and technological development) are harder to quantify. This review evaluates strategies of bauxite residue re‐use / recycling and identifies associated benefits beyond elemental recovery. Furthermore, methodologies to translate risks and benefits into quantifiable data are discussed. Ultimately, such quantitative data are a prerequisite for facilitating decision‐making regarding bauxite residue re‐use / recycling and a stepping stone towards developing a zero‐waste alumina production process. © 2018 The Authors. Unlicensed Mining (PETI) conducted by community groups in private forest area is rife in Muara Enim district which causing environmental degradation. The purpose of this study is to find out the institutional forms associated with illegal coal mining activities. The study used a qualitative approach that illustrated how unlicensed mining (PETI) still able to operate despite violating the law. The result of this study indicates the existing formal institutions did not run so well which lead to the creation of non-formal institutions who permits illegal activities. There are few technical requirements that PETI could not provide if they were legalized to be public mining. Good coordination and teamwork between government and law enforcers along with mining corporation are desirable to control the development of PETI and the impact it brings, especially in private forest.Keywords: private forest, institution, environmental damage, unlicensed mining, coal mining
