Truth Commission Impact: An Assessment of How Commissions Influence Politics and Society

Abstract: This article explains whether or not, and the specific ways in which, truth commissions established during a political transition in fact transform lessons from history into political and judicial impact, defined as influence on government policy and judicial processes. It isolates impact from the causal effects of similar postconflict institution building and other transitional justice and conflict resolution measures. Drawing upon the existing literature, it examines several causal mechanisms through which c… Show more

“…In most cases TCs have recommended measures to provide redress for victims, such as reparations, for the violations documented. Only early commissions, those in Uganda, Nepal, and Chad, have not recommended reparations (Bakiner 2014). While they usually recommend reparations, truth commissions do not award them.…”

“…This presents the challenge of isolating the impact of this TJM in comparison to other mechanisms that have been used. 7 Moreover, I only include qualitative analysis due to the shortcomings of the quantitative approach (Bakiner, 2014;Skaar & Malka, 2015). Finally, I add institutional reform 8 as a dependent variable, along with peace 9 and democracy, 10 because it is commonly included in truth commission recommendations and if implemented would show a clear impact of the TJM.…”

“…5 This has resulted in insufficient time for setting-up the commission, adequately preparing public hearings and engaging with communities across a country, as well as time to write an accurate report. 6 Scholars have used various methodologies to test the impact of TJMs, including qualitative studies (Bakiner, 2014;Fletcher, Weinstein, & Rowen, 2009;Skaar & Wiebelhaus-Brahm, 2013), quantitative studies (Olsen et al, 2010;Taylor & Dukalskis, 2012), and mixed-method approaches (Dancy et al, 2010;Van der Merwe et al, 2009;Wiebelhaus-Brahm, 2010). In trying to assess the impact of TJMs, the biggest challenge has been isolating the effect of one specific TJM, in our case truth commissions, in comparison to other factors that come into play in periods of transition.…”

“…This may involve informing the wider public of the nature and extent of past violations, contributing towards the development of ‘mutual understanding’ between former enemies or providing a basis for the structural and judicial reforms that may function as a starting point for the development of a more positive future (see e.g. Bakiner, 2013; Hayner, 2002; Llewellyn and Howse, 1999). The uncertainty surrounding the fate of the ‘disappeared’ is argued to provide a ‘specific drive’ for truth recovery (Cohen, 1995: 19).…”
