Within the Gricean framework only what is conversationally implicated is cancellable, whereas what is conventionally implicated and what is said cannot be cancelled without giving rise to contradiction. In the relevance-theoretic framework, however, the question is whether explicatures, which replace the Gricean notion of what is said, are cancellable. In recent years, various objections to the cancellability of explicatures have been raised. The aim of the present paper is to demonstrate that these objections are due to a misinterpretation of the Gricean cancellability test. In particular, they disregard the fact that this test is merely one of several diagnostic tools that are used by Grice to distinguish between conventional and conversational implicatures. Once we have recognized the essence of the cancellability test, the objections to the cancellability of explicatures turn out to be unwarranted.

Prime Minister’s Question time sessions are speech events in which questions are not only requests for information, and answers do not only provide the requested information. Speakers also exchange argumentation, so the illocutionary act of advancing argumentation can be regarded as a constitutive component of these speech events. More specifically, argumentation can precede the MP’s question to the Prime Minister and it can be part of the Prime Minister’s response to the MP’s question. The research tested the assumption that both (1) questions with clear locution and illocution and (2) questions with unclear locution and/or illocution can produce vague and/or ambiguous perlocutionary effects or consequences. Perlocutionary effects or consequences were classified into illocutionary and non-illocutionary perlocutionary effects or consequences (van Eemeren & Grootendorst 1984: 26–27). The analysis included 70 question-answer exchanges from two Question time sessions. The results demonstrate that disagreements can lead to non-answer responses.

In this article I analyze Kar and Radin’s critique of boilerplate text in contract. The problems identified in boilerplate are significant. I then describe the test that they offer to distinguish between proper contract and “pseudo-contract” in boilerplate. The test is constructed upon the use of Gricean Maxims slightly modified for the context of contract law. Next, Karl Llewellyn’s test for boilerplate is described. Ultimately, through the use of a couple of examples it is argued that Llewellyn’s test is a better option. Even with this result, much of the Kar and Radin critique of boilerplate is significant and valuable.
