Access to Land for the Urban Poor—Policy Proposals for South African Cities

Abstract: The issue of land is a critical one in post-Apartheid South Africa. Growing informality and poverty in urban areas, driven to a large extent by urbanisation, necessitates greater concerted action around land use management in urban areas to ensure more equitable, environmentally and socially sustainable use of finite land resources. The operation of the urban land market has been identified as a significant obstacle preventing the urban poor from accessing affordable land. A new approach, advocated by the UK D… Show more

“…Attempts to introduce a new act that strengthens the government's ability to expropriate have failed (2008,2013). Land reform has long been debated in South Africa as a rural-agricultural rather than as an urban issue (Beyers 2013, Brown-Luthango 2010. “…The urban poor have financial and other resource constraints that drive them to the informal land market (Brown-Luthango, 2010;Oladokun et al, 2010, Twarabamenye andNyandwi, 2012;Duran-Lasserve, undated). This informal (grey) market works through 'a simple sale contract' between buyer and seller, without formal registration with the authorities.…”

“…Similarly, de Vries and Cloete (2009) found that the various Acts and regulations in efforts to regularize land in Namibia have generated complexity and resulted in 'less of a solution for urban land tenure problems'. In South Africa, limited access to land is a major constraint for the urban poor to access housing and other economic opportunities despite several policy interventions by government (Brown-Luthango;2010;Planact, 2007). They showed complexity of the role of government at different levels, with conflicts between the Provincial Government and the Johannesburg City Council, when it comes to land planning and development and their respective mandates and development objectives.…”

“…A number of pro-poor thinkers argue for the expropriation of private property rights, rather than evictions of the poor, to be considered in cases where rights clash (Brown-Luthango, 2010: Wilson, 2011Berrisford & Greyling, forthcoming). However, local municipalities have been reluctant to jeopardise their rates bases, a vital source of income for the cities.…”
