The article aims to provide a comprehensive theoretical and practical analysis of the issues in the legal regulation of corruption prevention, study the state of the fight against corruption and the legalization of proceeds of corruption-related crimes under martial law, determine new corruption risks during a war, and suggest recommendations for their minimization. The authors of this article established the main problems that cause the emergence and spread of corruption in society and ways to overcome this phenomenon. The study’s results established that independent anti-corruption agencies and authorized law enforcement agencies have continued preventive and law enforcement activities even under war conditions, their purpose being to ensure the normal State functioning, the country’s defence capacity, and society’s security. In law-making and law enforcement activities, this research work can help to improve international relations between Ukraine and foreign countries in the context of the development of bilateral relations regarding the provision of assistance to Ukraine for post-war recovery, the attraction of investment, the fight against corruption, and possible accession to the European Union.

Pelanggaran berat hak asasi manusia (HAM) adalah pelanggaran yang sangat keji yang termasuk dalam klasifikasi kejahatan luar biasa. Tujuan dari penelitian ini adalah untuk mengkaji landasan hukum dan sifat mendesak dari penetapan pelanggaran HAM yang berat sebagai kejahatan luar biasa di Indonesia. Metodologi penelitian yang digunakan adalah penelitian hukum normatif, yang menggabungkan pendekatan perundang-undangan dan konseptual. Temuan dari penelitian ini menunjukkan bahwa Pengadilan Hak Asasi Manusia diatur dalam UU No. 26 Tahun 2000 terkait dengan pelanggaran hak asasi manusia yang berat. Namun demikian, penerapannya masih terbatas dan belum diklasifikasikan sebagai kejahatan luar biasa. Dengan mengklasifikasikan pelanggaran HAM berat sebagai kejahatan luar biasa, Indonesia dapat memperkuat komitmennya untuk melindungi hak asasi manusia, meningkatkan upaya pencegahan dan penghukuman, dan memperkuat keamanan di sekitar hak asasi manusia. Studi ini menyimpulkan bahwa undang-undang dan peraturan di Indonesia yang mengatur klasifikasi pelanggaran HAM berat sebagai kejahatan luar biasa harus direvisi.

Objectives. The study deals with international law mechanisms for human rights protection in education. The aim of the study is to analyse and evaluate the effectiveness of international law mechanisms for human rights protection in education. Theoretical Framework: The theoretical basis of the research was made up of the scientific works of scientists, quality and qualitative indicators of research, and the regulatory and legal framework. Methods: The research employed the method of comparison, visual graphic methods, a set of methods of processing, comprehension and interpretation of information. Results and Discussion: The study established the most common types of violations in the field of education, in particular: violation of the right of national minorities to education; impossibility of choosing the language of instruction; failure to provide inclusive education; discrimination against people with mental illness. Specific manifestations of the effectiveness of international law mechanisms for the human rights protection in the field of education are singled out, in particular: increasing public awareness and transparency of government activity, etc. Research Implications: The study gave grounds to draw the conclusions regarding the difficulty of proving the existence of violations in education. Attention is drawn to the subjectivity of the European Court of Human Rights (ECHR) and the ambiguous interpretation of norms enshrined in international legal acts. Originality/Value: The research is original, based on official data and the author's own conclusions, and has practical significance.
