Credit Disputes in Avila 1477 in the Context of Debt Relations Between Jews and Christians in Xv Century Castile

Abstract

This article is devoted to the study of the problem of debt relations between Jews and Christians in Castile at the end of the XV century on the example of debt disputes that were conducted in 1477 in the city of Avila between the alhamah of Jews, representing the side of creditors, and borrowers represented by Consejo and residents of the city and its land. Based on the material of the relevant royal charter, the article sets out the circumstances of the case, provides the testimony of the parties to the conflict, as well as the royal decision made on the consideration of appeals submitted to the royal court. The article also provides a detailed analysis of the source and attempts to reconstruct the sequence of events, motives and strategies of the parties. The author shows that the relationship between Jews and Christians in the field of lending was an essential element of social, economic and political life. These relations were accompanied by disputes, mutual deceptions, violations of rights, etc. However, despite the accompanying conflicts and contradictions, the solution of which was available through recourse to legal instruments, there is a stable interest of the parties – Jews, Christians, as well as the royal power – in these relations. Настоящая статья посвящена изучению проблемы долговых отношений иудеев и христиан в Кастилии в конце XV века на примере долговых споров, которые велись в 1477 г. в городе Авила между альхамой иудеев, представлявшей сторону кредиторов, и заемщиками в лице консехо и жителей города и его земли. На материале соответствующей королевской грамоты, в статье излагаются обстоятельства дела, приводятся показания сторон конфликта, а также королевское решение, вынесенное по рассмотрении поданных в королевский суд обращений. Также в статье дается подробный анализ источника и предпринимается попытка реконструировать последовательность событий, мотивы и стратегии сторон. Автор показывает, что отношения иудеев и христиан в сфере кредитования были существенным элементом социальной, экономической и политической жизни королевства. Данные отношения сопровождались спорами, взаимными обманами, нарушениями прав и т. д. Однако, несмотря на сопутствующие конфликты и противоречия, решение которых было доступно посредством обращения к правовым инструментам, обнаруживается устойчивая заинтересованность сторон – иудеев, христиан, а также королевской власти – в продолжении данных отношений.
