Elder law is often approached in terms of a ‘body’ of law. In this article, I argue for a contextualised and externalised perspective on the ageing individual as the subject of elder law. Elder law relates to the implications of law as an institutionalisation of society seen through the lens of older persons. The aged subject is a contested and differentiated social construct to be studied in relation to an externalised social ‘problem’ and properly contextualised. Whereas the ageing individual in the context of labour law and anti-discrimination regulation turns out to be remarkably young, the specific history of LGBT persons in society comes to the fore in cases where age intersects with a ground such as sexual orientation. The ‘ageing’ worker must thus be understood in relation to work as the dominant distributive order in society, and in relation to institutions and developments associated with work. Due to the role of age as a traditional social stratifier, the prohibition against age discrimination has been given a weaker format than have prohibitions against other kinds of discrimination, and the ban on ageism has failed to achieve a clear legal status. Deficiencies in the measures taken against age discrimination are also evident in their incapacity to address situations where age intersects with other grounds, resulting in a compartmentalised application and interpretation of discrimination bans, leaving vulnerable sub-groups without protection. In sum, elder law is very much a field in process and – although arguing for the added value of a contextualised perspective – it may for the time being suffice to say that ‘elder law is what elder law researchers do’.

La población de Personas Mayores, ha aumentado durante estos últimos años y se espera que siga así, llevándonos a indagar sobre la participación ocupacional de esta población en la Participación Social con compañeros/amigos y Actividades Básicas de la Vida Diaria, como la actividad sexual. Ambas ocupaciones se ligan a un solo fenómeno llamado sexualidad, considerado como fuente de bienestar global, de calidad de vida y un derecho. Frente a lo cual, surge como objetivo señalar el abordaje de la Terapia Ocupacional y sus profesionales en la sexualidad de Personas Mayores de acuerdo a la información empírica disponible, e identificar las teorías desde Terapia Ocupacional que guían el abordaje de la sexualidad como ocupación, desde una metodología argumentativa según las directrices que componen un ensayo. Se obtuvo que las investigaciones indican escasez del abordaje de la actividad sexual como ocupación y se encontró que el fenómeno de la actividad sexual y su problemática ocupacional, no cuenta con modelos e instrumentalización disciplinar.

Dialogues on the body image of the elderly: community empowerment strategy promoting health

Objective: to understand dialogues on body image with the elderly in Primary Health Care. Methods: action research, developed with 15 elderly participants of a coexistence group. The data were obtained by the techniques of photo-elucidation and emancipatory workshop, later submitted to the Descending Hierarchical Classification using the IRaMuTeQ® software. Paulo Freire's theoretical-analytical framework was followed. Results: aging reflected a combination between the representative changes of reality, with distorted visions and related to the jovial stereotype. Collective actions signaled that the elderly recognized the changes caused by old age, but these did not prevent them from participating in the group independent of their self-esteem, strengthening the process of empowerment. Conclusion: the concern of beauty and appearance as body representations imposed by society was highlighted, even with the natural marks of aging, the elderly feel satisfied with their body image. Métodos: pesquisa-ação, desenvolvida com 15 idosos participantes de um grupo de convivência. Os dados foram obtidos pelas técnicas de foto-elucidação e oficina emancipatória, posteriormente submetidos à Classificação Hierárquica Descendente utilizando o software IRaMuTeQ ® . Seguiu-se o referencial teórico-analítico de Paulo Freire. Resultados: o envelhecimento refletiu uma combinação entre as mudanças representativas da realidade, com visões distorcidas e relacionadas ao estereótipo jovial. As ações coletivas sinalizaram que os idosos reconheceram as modificações causadas pela velhice, mas estas, não impediram de participarem do grupo independente da sua autoestima, fortalecendo o processo de empoderamento. Conclusão: destacou-se a preocupação da beleza e aparência como representações corporais impostas pela sociedade, mesmo com as marcas naturais do envelhecimento, os idosos sentem-se satisfeitos com sua imagem corporal.
