“…However, what is unique about the digital age is that the risks that the internet presents—risks that raise challenges in terms of internet safety—are largely exacerbated by both its affordances (i.e., its technical features and what these do or do not enable users to do) and the nature of the digital environment (i.e., how internet corporations operate). Indeed, we are at a juncture in which public mistrust in the ability of tech companies to self-regulate the digital environment is rampant (Mansell, 2021 ). As a result, while both internet corporations and policymakers are confronted with the challenge of making ethical decisions about how the digital environment should be re-designed and managed (see, e.g., UK Government, 2020 ), users are presented with the task of navigating such an environment wisely—especially in the absence of meaningful regulation.…”

“…In the EU, risk-based regulation of IT generally emphasises self- and co-regulation by applying principles while simultaneously mandating compliance with normative standards and industry codes of conduct as evidence of adherence to regulatory principles (Ullrich, 2018; Colangelo et al, 2021). Most IT artefacts and digital infrastructure components such as AI (Gupta, 2022) and how data is processed and stored on platforms are now being subjected to growing regulation in the EU (Feld, 2019; Flew and Gillett, 2021; Mansell, 2021; Bennett, 2021; Nitzberg and Zysman, 2022). While analysing the EU’s approach to the regulation of IT, Mantelero et al (2020) identify the use of (1) principles-based provisions and technical rules; (2) standards-based technologies perceived as necessary in achieving data protection and security objectives; and (3) mechanisms such as risk assessment, compliance by-design, compliance reporting obligations, digital resilience, and the use of certification schemes to demonstrate compliance.…”
