Introduction: Every health organization aims to provide high-quality service and promote patient safety. However, achieving these goals can be challenging in many healthcare systems around the world. In dentistry, dentists can face medicolegal issues, which can be overcome by exploring the reasons for dental malpractice litigation. In this study, we aim to identify the most common causes and outcomes of dental malpractice litigation in the Kingdom of Saudi Arabia. Methods: This is a retrospective study. We reviewed all closed cases in dentistry as decided by the Medico-Legal Committee of Saudi Arabia in the Riyadh region over a period of 5 years and 3 months, from January 1, 2014, to March 31, 2019. Descriptive analysis was used to examine the phenomenon of dental malpractice claims. Results: In total, 151 claims were analyzed. As per our findings, it was determined that the number of closed claims had increased, with the highest number of claims (35%) related to the prosthodontics specialty, followed by endodontics specialty (31%). The most common causes of litigation were failure to conduct the procedure properly (31.5%) and poor documentation (19.7%). With respect to litigation outcomes, 54% ended up with verdict in favor of the plaintiff. Conclusions: It was determined that there is a rising trend of malpractice litigation in the dentistry field; thus, measures should be taken to address these concerns.

A doutrina e a jurisprudência não são unânimes a respeito do tipo de obrigação assumida pelos cirurgiões-dentistas perante seus pacientes. Há uma grande divergência se é uma obrigação de meio ou de resultado. Com base nas decisões judiciais e artigos analisados, observa-se que quando se tratam de procedimentos estéticos, a obrigação tende a ser caracterizada como de resultado pelos magistrados, principalmente em especialidades como Implantodontia, Ortodontia e Prótese Dentária. Ademais, a falta ou o incorreto preenchimento do prontuário odontológico contribui para que os profissionais sejam condenados nas ações propostas por pacientes. Cabe às Instituições de Ensino Superior conscientizarem e orientarem os discentes sobre a importância da documentação odontológica e o seu correto preenchimento durante o estágio da graduação. Com isso, espera-se que os futuros cirurgiões-dentistas estejam preparados para agir conforme os preceitos éticos e legais exigidos pela profissão. O presente trabalho trata-se de uma pesquisa bibliográfica realizada em bases de dados em formato eletrônico e livros, que tem como objetivo realizar uma revisão integrativa sobre a responsabilidade civil do cirurgião-dentista nos tratamentos odontológicos, ressaltando a importância e composição dos prontuários, a fim de resguardar os profissionais em futuros processos judiciais.

Dento-Alveolar Injuries (DAI) usually present with multiple trauma to many teeth and alveolar bones. Treatment protocols vary according to the type of injury. The prognosis is determined by the type of injury and adherence to the recommended treatment protocol. A pedestrian who has been knocked down by a motorcycle presented with an alveolar bone fracture where the plain radiographs implied to have root fractures. Meticulous clinical assessment together with confirmative investigation using Cone Beam Computerized Tomogram (CBCT) revealed the absence of root fractures. This enabled the implementation of a proper treatment protocol and a better prognosis for the affected teeth. It had a significant impact from a Medico-legal point of view as it determined the absence of root fractures and the presence of only alveolar bone fractures. Therefore, reduced the number of grievous injuries. Thus, it can affect the amount of punishment given to the motorcycle rider and the compensation given to the victim by the court.
